A RESOLUTION OF THE ART IN PUBLIC PLACES BOARD PURSUANT TO
CHAPTER 62, ARTICLE XVI ENTITLED "ART IN PUBLIC PLACES" OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), APPROVING
THE EXPENDITURE OF UP TO SIXTY-FOUR THOUSAND DOLLARS ($64,000.00)
FROM THE ART IN PUBLIC PLACES FUND, TO PROVIDE FOR, BUT NOT LIMITED
TO, DESIGN SERVICES, COMMISSIONING, ACQUISITION, AND INSTALLATION
OF PUBLIC ART AS PART OF A CALL TO ARTISTS FOR THE INTEGRATION OF
PUBLIC ART FOR FERN ISLE PARK LOCATED AT APPROXIMATELY 2300
NORTHWEST 14 STREET; MAKING FINDINGS; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on January 12th, 2017, pursuant to Ordinance No. 13656 and 13657, the
Miami City Commission enacted Phase I of the Art in Public Places Program and established
the Art in Public Places Program, the Public Art Fund, and the Art in Public Places Board
("AIPPB") along with its functions, duties, and powers; and
WHEREAS, Pursuant to Section 62-655(c)(3), the AIPPB, with the assistance and
recommendation of the Planning Department, Public Art Division, and all other City
Departments, as necessary, shall have the function, duties, and powers "[t]o approve
expenditures of the Public Art Fund as proposed by the City Manager or his/her designee"; and
WHEREAS, the City of Miami ("City") will construct an expansion of Fern Isle Park which
is subject to public art requirements pursuant to Article 11 entitled "Art in Public Places" of
Ordinance No. 13113, the Zoning Ordinance of the City of Miami (Miami 21 Code"); and
WHEREAS, the public art fee associated with the development of the new community
center has been deposited into the Public Art Fund in accordance with Article 11, Section 11.7;
and
WHEREAS, the City Manager, through his designee, proposed that the AIPPB expend
sixty-four thousand dollars ($64,000.00), which shall be used for design services for the
commissioning, acquisition and installation of public art for Fern Isle Park; and; and
WHEREAS, the City's Planning Department staff is recommended that the AIPPB
approve with conditions the expenditure of sixty-four thousand dollars ($64,000.00), which shall
be used for design services for the commissioning, acquisition and installation of public art for
Fern Isle Park; and
NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES BOARD OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Art in Public Places Board ("AIPPB") approves the expenditure of funds
in the total amount not to exceed sixty four thousand dollars ($64,000.00) for the
commissioning, acquisition and installation of public art for expanded portion of Fern Isle Park
with the following conditions:
The City's Public Art Division shall conduct a Call to Artists, requesting
qualifications from professional artists and/or artist teams to create integrated
artwork(s) for the Fern Isle Park.
2. The AIPPB, as part of the Call to Artists may select up to three (3) artists and/or
artist teams to develop specific proposals and compete for the commission(s).
Selected artists and/or artist teams shall receive a $1,200.00 honorarium.
3. Sixty thousand four hundred dollars ($60,400.00) shall be used for the
acquisition, permitting, installation, and associated costs of public art for Fern Isle
Park.
4. The AIPPB shall review the proposals from the artists and/or artist teams and
may select one (1) finalist for the commission of the public art for the community
center in accordance with Section 62-658 of the City Code.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Resolution is declared invalid, the remaining provisions of this Resolution shall not be affected.
Section 4. This Resolution shall be effective immediately upon its adoption.

A RESOLUTION OF THE ART IN PUBLIC PLACES BOARD PURSUANT TO
CHAPTER 62, ARTICLE XVI ENTITLED "ART IN PUBLIC PLACES" OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), APPROVING
THE SELECTION OF THE TOP SHORTLISTED ARTIST(S) IN ACCORDANCE WITH
SECTION 62-658 OF THE CITY CODE TO CREATE DESIGN PROPOSALS AS PART
OF A CALL TO ARTISTS FOR THE INTEGRATION OF PUBLIC ART FOR PBA
FERN ISLE PARK LOCATED AT APPROXIMATELY 2304 NORTHWEST 14
STREET; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on January 12, 2017, pursuant to Ordinance No. 13656 and
Ordinance No. 13657, the Miami City Commission established and enacted Phase I of
the Art in Public Places Program, requiring all applicable Government Development
Projects to allocate 1.5% of Project Cost towards the acquisition, commissioning, and
selection of Art; and
WHEREAS, the City of Miami ("City") will expand and make park enhancements
to PBA Fern Isle Park, which said improvements are subject to public art requirements
pursuant to Article 11, titled "Art in Public Places," of Ordinance No. 13114, the Zoning
Ordinance of the City of Miami, as amended, (Miami 21 Code"); and
WHEREAS, the Public Art fee associated with the proposed PBA Fern Isle Park
improvement has been deposited into the Public Art fund in accordance with Article 11,
Section 11.7 of the Miami 21 Code; and
WHEREAS, on April 15, 2019, the Art in Public Places Board ("AIPPB"), pursuant
to Resolution No. AIPP-R-19-008, approved with conditions the expenditure of up to
sixty -four -thousand dollars ($64,000.00) to be used for design services, commissioning,
acquisition, and installation of public art for PBA Fern Isle Park; and
WHEREAS, as part of the approval, the City's Public Art Division on April 10,
2019 conducted a Call to Artists, attached hereto as Exhibit A entitled "Call to Artist", in
accordance with Section 62-658 of the City Code, requesting qualifications from
professional artists and/or artist teams to create integrated artwork(s) for PBA Fern Isle
Park; and
WHEREAS, the Call to Artists closed on May 24, 2019 and the Public Art
Division received over 54 respondents from artists interested in competing for the final
public art commission; and
WHEREAS, as a required part of the Call to Artists, artists submitted specific
information such as an artist statement, a resume, and samples of their work; and
WHEREAS, the AIPPB has reviewed the artists' submittals pursuant to Exhibit B
entitled "Respondents to the Call to Artists, PBA Fern Isle Park"; and
WHEREAS, the AIPPB selected three (3) artists and/or artist teams, who shall
each receive a $1,200.00 honorarium to develop specific proposals to compete for the
commission(s); and
WHEREAS, the AIPPB hereby shortlist the following artists and/or artist teams to
develop specific Art proposals to compete for the final public art commission for PBA
Fern Isle Park:
1. Alex Yanes
2. Falon Mihalic
3. Actual Size Artworks
WHEREAS, the following alternate artist and/or artist team, in the event that one
of the shortlisted artists withdraw or decline shall develop specific proposals to compete
for the final public art commission for PBA Fern Isle Park.

NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. This Resolution shall be effective immediately upon its adoption.

A RESOLUTION OF THE ART IN PUBLIC PLACES BOARD PURSUANT TO
CHAPTER 62/ARTICLE XVI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), TITLED "PLANNING AND ZONING/ART IN PUBLIC
PLACES," APPROVING A PUBLIC ART PROPOSAL IN ACCORDANCE WITH
SECTION 62-658 OF THE CITY CODE FOR PBA FERN ISLE PARK LOCATED AT
APPROXIMATELY 2304 NORTHWEST 14 STREET, MIAMI, FLORIDA; MAKING
FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on January 12, 2017, pursuant to Ordinance Nos. 13656 and 13657
the Miami City Commission enacted Phase I of the Art in Public Places Program and
established the Art in Public Places Program requiring all applicable Government

WHEREAS, the City of Miami will construct two (2) new pocket parks which are
subject to public art requirements pursuant to Article 11 of Ordinance No. 13114, the
Zoning Ordinance of the City of Miami, Florida, as amended ("Zoning Code"), titled "Art
in Public Places"; and
WHEREAS, the Public Art fee associated with the development of the new
pocket parks has been deposited into the Public Art fund in accordance with Article 11,
Section 11.7 of the Zoning Code; and
WHEREAS, the City of Miami's ("City") Public Art Division, on April 10, 2019,
conducted a Call to Artists in accordance with Section 62-658 of the Code of the City of
Miami, Florida, as amended ("City Code"), requesting qualifications from professional
artists and/or artist teams (collectively, "Artists") to create integrated artwork for PBA
Fern Isle Park ("Park"); and
WHEREAS, on May 24, 2019, the call to artist closed and the Public Art Division
received numerous responses from Artists interested competing for the final public art
commission for the Park; and
WHEREAS, as part of the call to artists, Artists submitted specific information
such as an artist statement, resume, and samples of their work; and
WHEREAS, on April 15, 2019, pursuant to Resolution No. AIPP-R-19-008, the
Art in Public Places Board ("Board") approved, with conditions, the expenditure of up to
sixty-four thousand dollars ($64,000.00) for design services for the commissioning,
acquisition, and installation of public art for the new expansion of the Park; and
WHEREAS, on April 14, 2019, pursuant to Resolution No. AIPP-R-19-017 the
Board selected three (3) Artists to develop proposals and compete for the commissions
in which the selected Artists will receive a one thousand two hundred dollar ($1,200.00)
honorarium; and
WHEREAS, the Board shortlisted the following Artists to develop specific
proposals to compete for the final public art commission:
1. Actual Size Artworks
2. Alex Yanes
3. Falon Mihalic; and
WHEREAS, subsequently, the shortlisted Artists entered into professional artist
service agreements with the City to develop specific artist proposals and compete for
the commission; and
WHEREAS, the Public Art Division, in consultation with other City Departments,
has reviewed and ranked the proposals as prepared by the shortlisted Artists as follows:
1. Actual Size Artworks
2. Alex Yanes
3. Falon Mihalic; and
WHEREAS, the Public Art Division finds the proposed public art installation as
proposed by Actual Size Artworks, titled "Sky Canopy," to be in accordance with the
intent and criteria of Section 62-658 of the City Code, titled "Selections of Works of Art";
NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Board approves the artwork proposed by Actual Size Artworks.
Section 3. The Board directs the Public Art Division to invite Mr. Alex Yanes to
participate in a direct invitation in accordance with Chapter 62/Article XVI of the City
Code, titled "Planning and Zoning/Art in Public Places Program".
Section 4. This Resolution shall be effective immediately upon its adoption.
