The art has an appraised value of $350,000.00 in a form of a sculpture, the donation includes cost associated with the installation of the sculpture and provides for an endowment for maintenance equal to 10% of the appraised value. The sculpture is a site -specific art piece design specifically for Peacock Park. Background of Item: On September 21, 2020, the Art in Public Places Board pursuant to Resolution No. AIPP-R-20-014 approval with conditions the art installation pursuant to Chapter 62, Article XVI of the City Code. Subsequently, in April of 2021, the Office of the City Attorney indicated that it is in the best interest of the Commission to ratify, approve, and confirm certain actions related to the installation of the Art work as set forth in the Boards Resolution. WHEREAS, Hulu, LLC, a Delaware limited liability company ("Hulu"), has undertaken a nation-wide competition for art in public places in honor of Women's Equality Day and as part of Hulu's "Women's Equality Movement Project"; and WHEREAS, the City of Miami ("City"), through its Public Art Program, was selected as one (1) of three (3) cities (Atlanta, Los Angeles, and Miami) across the United States as a recipient of a site -specific public art sculpture, designed to commemorate the untold stories of women who helped to build these cities; and WHEREAS, for the City's installation, Hulu commissioned American artist Saya Woolfalk ("Artist") to create and donate a site -specific engaging public art monument in honor of Coconut Grove journalist, author, women's suffrage advocate, and conservationist Marjory Stoneman Douglas ("Douglas"), titled "Chapel for a River of Grass" ("Installation"), to be located at approximately 2820 McFarlane Road, Miami, Florida, also known as Peacock Park ("Property"); and WHEREAS, the Property is owned by the City and is currently zoned as Civic Space Transect Zone ("CS"); and WHEREAS, in the United States, there are approximately 394 monuments of women and 4,799 monuments of men; and WHEREAS, in an effort to address the disparity of equal representation of women in the public realm, Hulu, through its Women's Equality Movement Project, has partnered with the Artist to create an engaging public art Installation honoring one of the City's most famous pioneering women; and WHEREAS, as the only major American city founded by a woman, Julia Tuttle, the City has always been known for its innovation against a backdrop of lush tropical landscape; however, Miami is particularly vulnerable to environmental issues and residents of the City are keenly aware of the necessity of protecting the delicate ecosystem, partially due to the vocal consistent environmental advocacy of Douglas; and WHEREAS, Douglas' most influential book, The Everglades: River of Grass (1947), redefined the popular conception of the Everglades as a treasured river instead of a worthless swamp; and WHEREAS, there is no doubt that Douglas' commitment to defend the Everglades has impacted the ongoing restoration efforts to remedy damage inflicted on South Florida's environment during the 20t" century and her dedication and advocacy continues to inspire; and WHEREAS, the Artist is requesting to install a three-dimensional interactive public art Installation which will enhance the eastern portion of the Property as further described in Exhibit "A", attached and incorporated ("Artwork"); and WHEREAS, on August 26, 2020, a pre -application meeting with the City's Planning Department was held to review the Artist's request for a public art installation pursuant to Chapter 62, Article XVI, Section 62-658(b) of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, on September 21, 2020, the City's Art in Public Places Board ("Board"), pursuant to Resolution No. AIPP-R-20-014, approved the Artist's request for the Installation to honor Douglas; and WHEREAS, the Board reviewed the Artist's request pursuant to the selection of works of art criteria in Chapter 62, Article XVI, Section 62-658(2) of the City Code and Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), and found that it met the selection criteria therein, including that the location is in the preferred "areas used by tourists, including the waterfront, parks, thoroughfares, and at public or governmental facilities"; and WHEREAS, the Board found the request for the Installation at the Property to be consistent with the goals and intent of Chapter 62 of the City Code and the Miami 21 Code; and WHEREAS, the Installation, sponsored by Hulu, has an appraised value of Three Hundred Fifty Thousand Dollars ($350,000.00) and includes all costs associated with installation, with an endowment for its maintenance equal to an amount of ten percent (10%) of the appraised value as detailed in a donation letter, attached and incorporated as Exhibit "B" ("Donation Letter'), for the purposes of the Installation at the Property and an endowment therefor; and WHEREAS, the City's Planning Department's Public Art Division will provide for the continued maintenance of the Installation at the Property; and WHEREAS, the City finds the public art sculpture to be non -intrusive in nature and compatible with its environmental surroundings; and WHEREAS, it is in the best interests of the City for the City Commission to ratify, approve, and confirm certain actions related to the Installation as set forth in the Board's Resolution No. AIPP-R-20-014 and Exhibit "C", attached and incorporated, by the Board, the City's Planning Department, and other certain designated City officials and Departments which continue to accept additional funding and to take necessary actions to update the City's relevant financial controls and computer systems for the Installation, the Donation, and for any other grants and other funding sources in progress in connection herewith; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept the Donation of the Installation as described in Exhibit "A", attached and incorporated, from the Artist as detailed in the Donation Letter, attached and incorporated as Exhibit "B", for the purpose of installing the public art Installation at the Property. Section 3. The City's Planning Department's Public Art Division is authorized' to provide for continued maintenance of the Installation. Section 4. The City Manager is further authorized' to negotiate and execute any and all necessary documents, including but not limited to an Artwork Donation Agreement and an endowment agreement, all in forms acceptable to the City Attorney, to accept the Donation and the endowment. Section 5. The Artist shall comply with all applicable requirements as part of the building permitting process for the Installation at the Property. Section 6. The City Commission hereby ratifies, approves, and confirms certain necessary actions by the Board, the City's Planning Department, and other designated City Officials and Departments in order to provide initial authorizations, to update relevant financial controls and computer systems in connection with the Installation and the Donation, and for any other grants and other funding sources in progress in connection herewith. Section 7. This Resolution shall become effective immediately upon its adoption. ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
