City of Miami ` City Hall *' IIS I1,1P iI ITII � ,I -� Legislation g 3500 Pan American Drive r g _ ti Miami, FL 33133 R Resolution www.miamigov.com Enactment Number: R-21-0240 File Number: 9219 Final Action Date:6/10/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND APPROPRIATE THE ONE MILLION, SEVEN HUNDRED THOUSAND DOLLARS ($1,700,000.00) APPROPRIATED BY THE STATE OF FLORIDA ("STATE") TO THE CITY OF MIAMI ("CITY") FOR THE BADIA SENIOR CENTER PROJECT, THE ONE MILLION, FIVE HUNDRED THOUSAND DOLLARS ($1,500,000.00) APPROPRIATED BY THE STATE TO THE CITY FOR THE MIAMI GOLDEN PINES NEIGHBORHOOD IMPROVEMENTS PROJECT, AND THE THREE MILLION DOLLARS ($3,000,000.00) APPROPRIATED BY THE STATE TO THE CITY FOR THE MIAMI - LITTLE HAVANA PEDESTRIAN PRIORITY ZONES PROJECT (COLLECTIVELY, "STATE APPROPRIATED FUNDS"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AGREEMENTS WITH THE STATE, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF THE STATE APPROPRIATED FUNDS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, INCLUDING, BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE, IMPLEMENTATION OF, AND COMPLIANCE WITH THE AGREEMENTS FOR THE STATE APPROPRIATED FUNDS. WHEREAS, on June 2, 2021, Florida Governor Ron DeSantis signed Chapter 2021-36 of the Laws of Florida ("2021 General Appropriations Act"), attached and incorporated as Exhibit "A"; and WHEREAS, the 2021 General Appropriations Act, through the Florida Department of Elder Affairs' Services to Elders Program, appropriated One Million, Seven Hundred Thousand Dollars ($1,700,000.00) to the City of Miami ("City") for the Badia Senior Center project; and WHEREAS, the 2021 General Appropriations Act, through the Florida Department of Environmental Protection's Water Restoration Assistance Program, appropriated One Million, Five Hundred Thousand Dollars ($1,500,000.00) to the City for the Miami Golden Pines Neighborhood Improvements project; and WHEREAS, the 2021 General Appropriations Act, through the Florida Department of Transportation's Transportation Systems Operations Program, appropriated Three Million Dollars ($3,000,000.00) to the City for the Miami - Little Havana Pedestrian Priority Zones project; and WHEREAS the City Commission believes it is in the best interest of the City to accept, allocate, and appropriate the funds appropriated to it in the 2021 General Appropriations Act and to authorize the City Manager to negotiate and execute any and all agreements and other necessary related documents with the State of Florida ("State"), all in forms acceptable to the City Attorney, to implement acceptance and administration of the funds appropriated to the City; and WHEREAS, pursuant to Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the Miami City Commission, by a majority vote, deems this Resolution to be of an emergency nature in order to immediately protect the public's health, welfare, and safety; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. the: Section 2. The City Manager is authorized' to accept, budget, allocate, and appropriate 1. One Million, Seven Hundred Thousand Dollars ($1,700,000.00) appropriated by the State to the City for the Badia Senior Center project; 2. One Million, Five Hundred Thousand Dollars ($1,500,000.00) appropriated by the State to the City for the Miami Golden Pines Neighborhood Improvements project; and 3. Three Million Dollars ($3,000,000.00) appropriated by the State to the City for the Miami - Little Havana Pedestrian Priority Zones project (collectively, "State Appropriated Funds"). Section 3. The City Manager is further authorized' to negotiate and execute agreements with the State, all in forms acceptable to the City Attorney, to implement the acceptance and administration of the State Appropriated Funds. Section 4. The City Manager is further authorized' to negotiate and execute any and all other necessary documents, including, but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance, implementation of, and compliance with the agreements for the State Appropriated Funds. Section 5. Z If the Mayor does not sign this Resolution, it shall become effected at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
