City of Miami ` City Hall I%P i,,4to � „ „ - Legislation g 3500 Pan American Drive r g _ ti Miami, FL 33133 R Resolution www.miamigov.com Enactment Number: R-21-0237 File Number: 9205 Final Action Date:6/10/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION SUPPORTING THE RIGHTS, FREEDOMS, AND EQUAL TREATMENT OF LESBIAN, GAY, BISEXUAL, TRANSGENDER, AND QUEER ("LGBTQ") PEOPLE IN THE CITY OF MIAMI ("CITY') AND ENCOURAGING THE CELEBRATION OF JUNE 2021 AS "LGBTQ PRIDE MONTH" IN THE CITY TO PROVIDE A LASTING OPPORTUNITY FOR ALL PEOPLE TO LEARN ABOUT THE DISCRIMINATION AND INEQUALITY THAT THE LGBTQ COMMUNITY ENDURED AND CONTINUES TO ENDURE AND TO CELEBRATE THE CONTRIBUTIONS OF THE LGBTQ COMMUNITY THROUGHOUT HISTORY. WHEREAS, individuals who are lesbian, gay, bisexual, transgender, and queer ("LGBTQ") include individuals from all faiths, races, national origins, socioeconomic statuses, education levels, and political beliefs; and WHEREAS, LGBTQ people in the City of Miami ("City") have made and continue to make vital contributions to the City and to the world in every aspect, including in the fields of education, law, health, business, science, research, economic development, architecture, fashion, sports, government, music, film, technology, literature, civil rights, and politics; and WHEREAS, LGBTQ people in the City serve as law enforcement officers, firefighters, and first responders; and WHEREAS, on June 26, 2015, the Supreme Court of the United States ruled in Obergefell v. Hodges, 135 S. Ct. 2584 that same -sex couples have a constitutional right to marry and acknowledged that "many same -sex couples provide loving and nurturing homes to their children," and that laws prohibiting same -sex -marriage "harm and humiliate the children of same -sex couples"; and WHEREAS, LGBTQ people face disparities in employment, healthcare, education, and many other areas central to the pursuit of happiness; and WHEREAS, LGBTQ youth are at increased risk of suicide, homelessness, and becoming victims of bullying and violence; and WHEREAS, the LGBTQ community has faced discrimination, inequality, and violence throughout history; and WHEREAS, LGBTQ people, in particular transgender individuals, face a disproportionately high risk of becoming victims of violent hate crimes; and WHEREAS, members of the LGBTQ community have been targeted in acts of mass violence, including the Pulse nightclub shooting in Orlando, Florida on June 12, 2016, where 49 people were killed, and the arson attack at the UpStairs Lounge in New Orleans, Louisiana on June 24, 1973, where 32 people died; and WHEREAS, LGBTQ people face persecution and violence in many parts of the world, including State -sponsored violence; and WHEREAS, in 2009, President Barack Obama signed "Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act" (Public Law 111-84; 123 Stat. 2835) into law to protect all people in the United States from crimes motivated by the actual or perceived sexual orientation or gender identity of an individual; and WHEREAS, the demonstrators that protested on June 28, 1969 following a law enforcement raid of the Stonewall Inn, an LGBTQ club in New York City, are pioneers of the LGBTQ movement for equality; and WHEREAS, on February 13, 2020, the City Commission unanimously adopted an Ordinance amending the Code of the City of Miami, Florida, as amended ("City Code"), to create the "Lesbian, Gay, Bisexual, Transgender, Queer Advisory Board" ("Board"); and WHEREAS, the purpose of the Board is to serve as a vehicle for systematic and periodic assessment of the quality of life of LGBTQ residents and visitors to the City; to make recommendations to the City Commission with respect to all issues affecting or relating to the LGBTQ community; to recommend to the City Commission solutions to the social economic, cultural, and political problems in the LGBTQ community; and to serve as liaison between the LGBTQ community and the City's community at large; and WHEREAS, LGBTQ people have fought for equal treatment, dignity, and respect; and WHEREAS, LGBTQ people have achieved significant milestones, ensuring that future generations of LGBTQ people in the United States will enjoy a more equal and just society; and WHEREAS, despite being marginalized throughout history, LGBTQ people continue to celebrate their identities, love, and contributions in various expressions of Pride; and WHEREAS, on June 7, 2021, the Board unanimously passed a resolution in support of future legislation in the City celebrating and honoring LGBTQ Pride 2021; and WHEREAS, the inclusion of LGBTQ people continues to expand every day and LGBTQ people remain determined to pursue equality, respect, and inclusion for all individuals regardless of sexual orientation or gender identity; and WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission supports the rights, freedoms, and equal treatment of LGBTQ people in the City, the State of Florida, the United States, and around the world. Section 3. The City Commission acknowledges that LGBTQ rights are human rights that are to be protected by the United States Constitution and numerous international treaties and conventions. Section 4. The City Commission commits to ensuring the equal treatment of all people in the City, regardless of sexual orientation and gender identity. Section 5. The City Commission commits to ensuring that the City remains a beacon of hope for the equal treatment of people around the world, including LGBTQ individuals. Section 6. The City Commission encourages the celebration of June as "LGBTQ Pride Month" in order to provide a lasting opportunity for all people in the City to learn about the discrimination and inequality that the LGBTQ community endured and continues to endure and to celebrate the contributions of the LGBTQ community throughout history. Section 7. This Resolution shall become effective immediately upon its adoption.
