City of Miami ` City Hall -� Legislation g 3500 Pan American Drive r g _ ti Miami, FL 33133 R Resolution www.miamigov.com Enactment Number: R-21-0242 File Number: 9222 Final Action Date:6/10/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO SET UP A REWARD PROGRAM OF $500.00 PER CASE AND A HOTLINE FOR MEMBERS OF THE GENERAL PUBLIC WHO PROVIDE TIPS ON ILLEGAL DUMPERS THAT LEAD TO EITHER A CIVIL OR CRIMINAL PROSECUTION AND CONVICTION. WHEREAS, the City of Miami (City") provides excellent sanitation services for its residents; and WHEREAS, residential properties receive two (2) pick-ups of binned garbage, one (1) pick-up of recycling, and one (1) pick-up of bulky trash each week from the Department of Solid Waste ("Solid Waste"); and WHEREAS, other areas in Miami -Dade County, including unincorporated Miami -Dade County, do not provide such a high level of service to their residents, and WHEREAS, the City also picks up dumped trash and garbage left along streets, alleyways, and in empty lots on a regular basis to keep our City clean; and WHEREAS, because the City's services are effective and reliable, contractors, lawn services, multi -unit residential owners and tenants, and others who are working or living in the City and even those who are outside the City's limits have used City streets as their dumping grounds rather than through the approved methods; and WHEREAS, these actions are not acceptable and although the City uses the 311 system to track and respond to illegal dumping, catching the culprits and fining and/or arresting them for their illegal acts is the best way to curb these activities and to clean up the City's streets, and WHEREAS, the materials dumped illegally are often hazardous chemicals, construction materials, landscaping remnants that provide harbor for vermin, and other debris that is required to go to landfills or to specialized disposal sites; and WHEREAS, Section 22-6 of the Code of the City of Miami, Florida, as amended ("City Code"), and Section 403.413, Florida Statues ("Florida Litter Law"), provide for both civil and criminal punishments for violators; and WHEREAS, although Crimestoppers is an effective tip line for criminal activity, it is not used for enforcement of violations of the Florida Litter Law; and WHEREAS, illegal dumping creates a hazard and is a blight on our streets for all to see and taking a stronger stance against these illegal activities by enlisting the help of our residents and business owners to call in the violations and report who is illegally dumping is in the best interests of the City; and WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission hereby directs the City Manager to set up a reward program of $500.00 per case and a hotline for members of the general public who provide tips on illegal dumpers that lead to either a civil or criminal prosecution and conviction. Section 3. This Resolution shall become effective immediately upon its adoption.
