IiRl 11 +*� Resolution: R-21-0212 File Number: 9144 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/27/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO APPROVE AND ISSUE A RIGHT-OF-WAY PERMIT AND NON-STANDARD RIGHT-OF-WAY IMPROVEMENTS AGREEMENT RELATED TO SAWYER'S WALK LOCATED NEAR NORTHWEST 7 STREET BETWEEN NORTHWEST 2 AVENUE AND NORTHWEST 3 AVENUE, MIAMI, FLORIDA, AS DEPICTED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO BLOCK 55 OWNER, LLC AND ITS ASSIGNS ("DEVELOPER") FOR THE PURPOSES OF THE DEVELOPER TO USE THE AREA FOR CONSTRUCTION STAGING AND FOR MAKING IMPROVEMENTS TO SAWYER'S WALK. SPONSOR(S): Commissioner Jeffrey Watson WHEREAS, the City of Miami ("City") has jurisdiction over the public right-of-way in the location of Northwest 7 Street between Northwest 2 Avenue and Northwest 3 Avenue, Miami, Florida, as depicted in Exhibit "A," attached and incorporated ("Sawyer's Walk"); and WHEREAS, pursuant to Resolution No. R-86-118 adopted on February 13, 1986, Sawyer's Walk was closed to vehicular traffic and has served as a pedestrian promenade in honor of the historic figure W.B. Sawyer; and WHEREAS, Sawyer's Walk is in need of improvements and redevelopment in order to become the community resource and pedestrian access route that the right-of-way was intended to be; and WHEREAS, Block 55 Owner, LLC and its assigns ("Developer") is the owner of the property located at 249 Northwest 6 Street, Miami, Florida ("Block 55 Property"); and WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency is a public agency created pursuant to Section 163.356, Florida Statutes ("CRA"); and WHEREAS, the CRA's main objective is to spearhead new development and redevelopment efforts that accomplish beneficial revitalization within the CRA Redevelopment Area; and WHEREAS, the CRA was the previous owner of the Block 55 Property and transferred title of the Block 55 Property to the Developer on September 2, 2020, subject to development restrictions; and WHEREAS, the Developer is a party to that certain Block 55 Restrictive Covenant by and between the Developer and the CRA recorded in Official Records Book 32095, Page 3457 of the public records of Miami -Dade County, Florida ("Block 55 Restrictive Covenant"); and City of Miami Page 1 of 3 File ID: 9144 (Revision:) Printed On: 611412021 File ID: 9144 Enactment Number: R-21-0212 WHEREAS, pursuant to the Block 55 Restrictive Covenant, the Developer agrees to develop a mixed -use project to be located on the Block 55 Property consisting of (i) not less than 578 residential units, (ii) not less than 250,000 rentable square feet of retail/restaurant/entertainment uses and a portion of which may consist of office space, (iii) a minimum of 925 parking spaces, and (iv) the improvement of the Sawyer's Walk, all as more particularly described in the Block 55 Restrictive Covenant (collectively, "Block 55 Project"); and WHEREAS, the terms of the Block 55 Restrictive Covenant also require the Developer to improve and maintain Sawyer's Walk in good condition for a period of thirty (30) years; and WHEREAS, in order to satisfy the terms of the Block 55 Restrictive Covenant and develop the Block 55 Project, including Sawyer's Walk, the City must grant the Developer access for staging, construction, and maintenance related to Sawyer's Walk; and WHEREAS, the improvements, prior to any construction, shall be subject to the review and approval of City staff; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized' and directed to issue a right -of way -permit for the Development, which shall be in accordance with all local laws, regulations, and requirements and consistent with the Maintenance of Traffic ("MOT") plan, attached and incorporated as Exhibit "B," for a minimum period of thirty (30) months. Section 3. The City Manager is authorized' and directed to execute the non-standard improvements covenant, in a form acceptable to the City Attorney, to permit the Developer to construct and maintain improvements to Sawyer's Walk. Section 4. This Resolution shall become effective immediately upon adoption and signature of the Mayor.2 ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
