Subject: Sole Source - Sop Technologies Storm Water Inlet Filters
Purpose of Item:
The nature of this item is to seek a resolution of the Miami City Commission, by a four -
fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the Code of the City of
Miami, Florida, as amended ("city code"), after an advertised public hearing, ratifying,
authorizing, and confirming the City Manager's finding of a sole source; waiving the
requirements for competitive sealed bidding procedures and approving the purchase of
SOP Technologies Storm Water Inlet filters, installation of said filters, storm drain
marking services and annual reporting services from Eddie Lopez Technology, LLC
d/b/a Stop Ocean Pollution ("SOP Technologies") for the Department of Resilience and
Public Works ("Public Works"), for a purchase amount of $269,500.00 to be allocated
from 40-13213800 Award 1431 plus a contingency in the amount of $10,000.00 for
maintenance of traffic ("MOT") incidentals to be allocated from, other various sources of
funds from Public Works, subject to the availability of funds and budgetary approvals, at
time of need for a total amount of $279,500.00, authorizing the City Manager to
negotiate and execute all other documents, including any amendments, renewals, and
extensions, subject to all allocations, appropriations, and prior budgetary approvals, and
in compliance with all applicable provisions of the code of the City of Miami, Florida, as
amended ("City Code"), including the City of Miami's Procurement Ordinance, Anti -
Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the
City Code, all in a form acceptable to the City Attorney, and in compliance with all
applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Background of Item:
Public Works has a continuous duty to mitigate the effects of pollution in the City's
waterways. The department currently has twenty (20) SOP inlet filters installed around
the City. Over the past fourteen (14) months, it has been found that the inlet filters
remarkably reduced the volume of large and small contaminants into the storm water
system while the smaller grove and lateral technology conveys the water flow into the
inlets.
The SOP Technologies inlet filter are produced solely by Eddie Lopez Technologies,
LLC d/b/a SOP Technologies International ("SOP") and are uniquely designed to
address the specifications of water quality protection needs. Filters are registered under
US Patent No. 8,017,006. Public Works has received a quote for 1,000 SOP
Technologies patented storm water inlet filters with installation, storm drain marker
services at each filter site and an annual report showing the impact of the filters for the
purchase price of $269,500.00 with an added contingency of $10,000.00 for
maintenance of traffic ("MOT") incidentals for a total cost of $279,500.00

A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, AUTHORIZING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF A SOLE SOURCE, WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING METHODS, AND APPROVING THE PURCHASE
OF SOP TECHNOLOGIES STORMWATER INLET FILTERS ("STORMWATER
FILTERS"), INSTALLATION OF SAID FILTERS, STORM DRAIN MARKING
SERVICES, AND ANNUAL REPORTING SERVICES FROM EDDIE LOPEZ
TECHNOLOGIES, LLC D/B/A SOP TECHNOLOGIES INTERNATIONAL, A FLORIDA
LIMITED LIABILITY COMPANY ("SOP TECHNOLOGIES"), FOR THE CITY OF
MIAMI'S ("CITY") DEPARTMENT OF RESILIENCE AND PUBLIC WORKS ("PUBLIC
WORKS") FOR A TOTAL AMOUNT OF TWO HUNDRED SEVENTY NINE THOUSAND
FIVE HUNDRED DOLLARS ($279,500.00), COMPRISED OF A PURCHASE AMOUNT
OF TWO HUNDRED SIXTY NINE THOUSAND FIVE HUNDRED DOLLARS
($269,500.00) TO BE ALLOCATED FROM PROJECT NO. 40-13213800 WITH AWARD

NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND
EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR
BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS
OF THE CITY CODE, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -
DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH
IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND
REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has made a finding that Eddie Lopez
Technologies, LLC d/b/a SOP Technologies International, a Florida limited liability company
("SOP Technologies"), is the sole source developer and distributor of SOP Technologies
Stormwater Filters ("Stormwater Filters"); and
WHEREAS, the City of Miami's ("City") Department of Resilience and Public Works
("Public Works") requires improved technology for compliance with their efforts to control water
pollution, which will continue to protect the City's residents and provide the City with cleaner
waterways; and
WHEREAS, the Stormwater Filters have been shown to prevent larger and smaller sized
particle contaminants from entering the stormwater system due to its use of a smaller grove and
lateral technology for conveyance of waterflow into the inlets; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and
adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive sealed bidding methods be waived and that the procurement of
said Stormwater Filters, as specified, be approved; and
WHEREAS, following the required published notice prior to award, the City Commission
would be ratifying and approving, by a four -fifths (4/51") affirmative vote, the waiver of
competitive sealed bidding methods as not being practicable for this sole source;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City
Code, after an advertised public hearing, the City Manager's finding of a sole source, waiving
the requirements for competitive sealed bidding methods, and approving the purchase of the
Stormwater Filters, installation of said filters, storm drain marking services, and annual reporting
services from SOP Technologies for Public Works for a total amount of Two Hundred Seventy
Nine Thousand Five Hundred Dollars ($279,500.00) is hereby ratified, authorized, and
confirmed.
Section 3. Funds shall be allocated in the amount of Two Hundred Sixty -Nine Thousand
Five Hundred Dollars ($269,500.00) from Project No. 40-13213800 with Award 1431, plus a
contingency for maintenance of traffic incidentals in the amount of Ten Thousand Dollars
($10,000.00) from other various sources of funds from Public Works, subject to the availability of
funds and budgetary approval at time of need.
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the City
Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
