R-19-0523 ADOPTED ON DECEMBER 12, 2019 AND RESOLUTION NO. R-20-0377 ADOPTED NOVEMBER 19, 2020, TO OCTOBER 28, 2021. WHEREAS, pursuant to Resolution No. R-19-0523 adopted on December 12, 2019, the City Commission directed the City Manager and the City Administration to work with the Miami 21 Report Ad Hoc Task Force ("Task Force 1") to conduct a comprehensive review of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code"); evaluate the development direction of the City of Miami ("City"); issue a report; and report to the City Commission findings, recommendations, and proposed changes to the Miami 21 Code within one hundred eighty (180) days (collectively, "Report"); and WHEREAS, pursuant to Resolution No. R-20-0015 adopted on January 23, 2020, the City Commission established Task Force 1 and members were subsequently appointed; and WHEREAS, on March 12, 2020, Mayor X. Francis Suarez declared a local State of Emergency due to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, pursuant to Ordinance No. 13902 adopted on May 28, 2020, the City Commission tolled the time period to present to the Report to City Commission due to the COVID-19 pandemic; and WHEREAS, pursuant to Ordinance No. 13921 adopted by the City Commission on September 24, 2020, the tolling period ceased on September 24, 2020; and WHEREAS, the original deadline to submit the Report to the City Commission as a result of Ordinance No. 13902 was December 22, 2020; and WHEREAS, pursuant to Resolution No. R-20-0298 adopted on September 24, 2020, the City Commission rescinded Resolution No. R-20-0015, abolished Task Force 1, and directed the City Manager and City Attorney to develop a new task force; and WHEREAS, pursuant to Resolution No. R-20-0320 adopted on October 8, 2020, the City Commission established a new Miami 21 Task Force ("Task Force 2") to give its perspective and recommendations for possible recommended changes and measures to be taken relative to the Miami 21 Code and provided for its sunsetting either when Task Force 2 delivers its recommendations to the Mayor, City Commission, and City Manager or on October 7, 2021, whichever occurs first; and WHEREAS, the City's Administration has been diligently working on the Report, including working with Task Force 2, but finds that it needs additional time to complete the Report; and WHEREAS, aligning the City Administration's timeline with that of Task Force 2 will provide the requested additional time necessary for the City's Administration as well as provide the benefit of input from Task Force 2, composed of individuals who regularly use and work with the Miami 21 Code and are familiar with planning, zoning, and land use principles; and WHEREAS, this proposed extension will have no effect on the sunset of the Miami 21 Taskforce which will automatically occur once the Miami 21 Task Force delivers its recommendations to the Mayor, City Commission, and City Manager or on October 7, 2021, whichever occurs first; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby extends the time period for the City's Administration to provide its Report to the City Commission to October 28, 2021. Section 3. This Resolution shall become effective immediately upon its adoption.
