File ID: #8673
Date: 02/24/2021 Requesting Department: Department of Real
Estate and Asset Management
Commission Meeting Date: 04/22/2021 Sponsored By:
District Impacted: District 3
Type: Resolution
Subject: Brownfield Area Designation Request
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), designating the
properties located at 145, 155, 165 and 191 SW 12th Street and 1133, 1131, 1115 and
1105 SW 2nd Avenue, Miami, FL 33130 as a Brownfield area within the City of Miami,
Florida, pursuant to Chapter 376.80(2)(a), Florida Statutes.
Background of Item:
The City of Miami ("City") is the owner of Fire Station No. 4, located at 1105, 1115,
1131, and 1133 SW 2nd Avenue, Miami, Florida 33130 ("City Property"). 191 SW 12
Owner, LLC ("191 SW 12") is the owner of the properties located at 145, 155, 165 and
191 SW 12th Street, Miami, Florida 33130 ("191 SW 12 Property"). The City Property
and 191 SW 12 Property (collectively the "Subject Property") were combined in
furtherance of, and subject to, a Public Benefits Agreement entered into by 191 SW 12
and the City, as authorized by Resolution R-20-0059 ("PBA").
The PBA provides for various public benefits to the City, including the development of a
new Fire Station, and further enables 191 SW 12 to construct a private development
and other components on the Subject Property. 191 SW 12 has submitted the attached
request to designate the Subject Property as a Brownfield area pursuant to Chapter
376.80(2)(a), Florida Statutes.
The current City of Miami Brownfield Area boundary, attached hereto, does not include
the Subject Property; however, an individual Brownfield Designation can occur via
majority vote of the jurisdiction's governing body. On March 11, 2014, the County issued
a notice of environmental contamination in Southside park, located adjacent to the
Subject Property. 191 SW 12 is applying for the Brownfield Area Designation due to the
fact that there is actual contamination on the Subject Property as well as a significant
perception of contamination arising from its location adjacent to Southside Park. The
City Commission has determined that the Subject Property has met the criteria to be
designated as a Brownfield site.
