IloiukvAiirnand Irnanl% %SVX aIHm AMENDED RESOLUTION SUBMITTED INTO THE PUBLIC RECORD FOR ITEM(S)LiL44g1ON t►lloliq yyy5 WHEREAS, the proposed development entitled Coconut Grove Apartments, hereinafter referred to as the "Project" and located at 3069, 3091 and 3095 Plaza Street, Miami, Florida, was presented by one of the developers of the Project, Cornelius Shiver, at the January 28, 2019 regular monthly meeting of the Coconut Grove Village West Homeowners and Tenants Association, hereinafter referred to as "HOATA"; and WHEREAS, Cornelius Shiver stated and depicted through an architectural rendering that the Project would consist of thirty-two (32) units, with the potential of fifty-two units if passage of the proposed revised legislation of the Neighborhood Conservation District 2 (NCD-2) occurred; and WHEREAS, it was further stated that twenty (20%) of the units would be set aside for non -subsidized, workforce housing at monthly rental rates of $ 1,200.00 to $ 1,300.00 (80% AMI); and WHEREAS, it was further stated that applications to request zoning classification and land use designation upgrades would be submitted to the City of Miami, Florida for approval; and WHEREAS, it was further stated that a twenty percent (20%) contribution would made to the community in the form of a Community Benefits Agreement, hereinafter referred to as "CBA"; and WHEREAS, HOATA unanimously passed a Resolution in support of the Project as presented at said meeting on January 28, 2019. NOW BE IT HEREBY RESOLVED that the Executive Board of HOATA endorses the proposed Project only if a mutually agreed upon Community Benefits Agreement (CBA) is executed and enforced prior to the commencement of construction of the Project. BE IT FURTHER RESOLVED that failure to execute a Community Benefits Agreement, within and up to the time stated, will render HOATA's endorsement of the Project null and void.
