HomeMy WebLinkAboutPre-LegislationCity of Miami J'f Legislation Resolution: R-20-0252 File Number: 7717 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/10/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE SECOND ALLOCATION OF EMERGENCY SOLUTIONS GRANT ("ESG-CV2") FUNDS IN THE TOTAL AMOUNT OF $6,132,699.00 FOR FISCAL YEAR 2019-20 AND APPROPRIATING SAID FUNDS AS MORE PARTICULARLY SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, IN ORDER TO BE USED TO PREVENT, PREPARE FOR, AND RESPOND TO THE NOVEL CORONAVIRUS ("COVID-19") PANDEMIC FOR INDIVIDUALS AND FAMILIES WHO ARE HOMELESS, ARE ABOUT TO BECOME HOMELESS, OR ARE RECEIVING HOMELESS ASSISTANCE TO MITIGATE THE IMPACTS OF THE COVID-19 PANDEMIC; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. R-20-0137 adopted April 30, 2020, the City Commission approved an allocation of funds in the amount of $1,633,034.00 in supplemental Emergency Solutions Grant ("ESG-CV") funds for fiscal year 2019-2020 under the Coronavirus Aid, Relief and Economic Security ("CARES") Act; and WHEREAS, on June 9, 2020, the City of Miami ("City") was awarded a second allocation of ESG-CV funds from the United States Department of Housing and Urban Development ("HUD") for a total amount of $6,132,699.00 ("ESG-CV2") pursuant to the CARES Act, Public Law No. 116-136; and WHEREAS, there is a need to accept these funds in order for the City to prevent, prepare for, and respond to the novel coronavirus ("COVID-19") pandemic to assist individuals and families who are homeless, are about to become homeless, or are receiving homeless assistance; and WHEREAS, the funds will also support additional homeless assistance and homelessness prevention activities to mitigate the impacts of the COVID-19 pandemic; and WHEREAS, the City's Administration recommends accepting the ESG-CV2 funds from HUD in the total amount of $6,132,699.00 and appropriating said funds as specified in Exhibit "A," attached and incorporated, to be used to prevent, prepare for, and respond to the COVID- 19 pandemic for individuals and families who are homeless, are about to become homeless, or are receiving homeless assistance to mitigate the impacts of the COVID-19 pandemic; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 7717 (Revision:) Printed On: 912512020 File ID: 7717 Enactment Number: R-20-0252 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The second allocation of ESG-CV2 funds in the total amount of $6,132,699.00 for FY 2019-20 and the appropriation of said funds as more particularly specified in Exhibit "A," attached and incorporated, in order to be used to prevent, prepare for, and respond to the COVID-19 pandemic for individuals and families who are homeless, are about to become homeless, or are receiving homeless assistance to mitigate the impacts of the COVID- 19 pandemic is approved. Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 4na de z, City Attor iey 8/3112020 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
