Background of Item: The Department of Housing and Community Development ("Department") receives various types of repayments from loans provided to developers and homeowners in the past, such funds referred to as program income, are required to be used for eligible program activities. From August 1, 2020 to January 31, 2021, the Department of Housing and Community Development has collected an amount of $139,770.27 in Community Development Block Grant ("CDBG") program income. Pursuant to CDBG regulations 24 CFR Part 570.504, program income must be used for eligible CDBG activities. The Department recommends the allocation of the program income from CDBG funds generated August 1, 2020 to January 31, 2021 in the amount of $139,770.27 for eligible housing and economic development activities, as specified in Exhibit "A" attached and incorporated. WHEREAS, the Department of Housing and Community Development ("Department") periodically receives various types of repayments from loans provided to developers and homeowners ("Funds"); and WHEREAS, from August 1, 2020 to January 31, 2021, the Department has collected an amount of $139,770.27 in Community Development Block Grant ("CDBG") program income; and WHEREAS, pursuant to CDBG regulation 24 CFR Part 570.504, program income must be used for eligible CDBG activities; and WHEREAS, the Department recommends the allocation of the CDBG program income that was generated from August 1, 2020 to January 31, 2021 in the amount of $139,770.27 for eligible housing and economic development activities specified in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of program income from CDBG funds generated from August 1, 2020 to January 31, 2021 in the amount of $139,770.27 for eligible housing and economic development activities specified in Exhibit "A", attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption. ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
