A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING A PERPETUAL EASEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, FROM JUAN F. TARANCON AND OMAIRA GRAJALES TO ACCOMMODATE
PUBLIC INGRESS AND EGRESS OVER AND UPON THE PORTION OF THE
STREET LOCATED ON PRIVATE PROPERTY AT 430 SOUTHWEST 31 ST AVENUE,
MIAMI, FLORIDA 33125 AND SUPPORT THE CITY OF MIAMI'S ROADWAY
RECONSTRUCTION AND NARROWING PROJECT AT CORAL NOOK CIRCLE,
OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-13193601.
WHEREAS, the Coral Nook Circle Improvement Project, Office of Capital Improvements
("OCI") Project No. 40-13193601, located at the traffic circle at the intersection of Southwest 51h
Street at Southwest 31st Avenue, north to Southwest 41" Street, south to Southwest 61" Street,
east to Southwest 32nd Avenue, and west to Southwest 301" Avenue in Miami, Florida is
adjacent to and encroaches into an existing street located on private property located at 430
Southwest 31s' Avenue, Miami, Florida 33125; and
WHEREAS, the City of Miami ("City") desires to assure public ingress and egress
access to the street located on the private property; and
WHEREAS; the owners of the property, Juan F. Tarancon and Omaira Grajales
("Property Owners"), offered to grant a perpetual easement to the City for said purposes
("Perpetual Easement"); and
WHEREAS, the City will construct, maintain, and assume responsibility for the portion of
the street located on the private property; and
WHEREAS, the City agrees with the terms, conditions, and easement area in the
Perpetual Easement, attached hereto and incorporated as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept the Perpetual Easement, in
substantially the attached form, from the Property Owners to accommodate public ingress and
egress access to the portion of the street located in the easement area.
Section 3. This Resolution shall become effective immediately upon its adoption.
' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
