A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ADOPTING THE FINDINGS OF MIAMI-DADE COUNTY ("COUNTY") THAT, IN
ACCORDANCE WITH SECTION 163.335, FLORIDA STATUTES, THE GEOGRAPHIC
AREA LOCATED IN THE CITY OF MIAMI ("CITY") GENERALLY BOUNDED ON THE
NORTH BY BIRD ROAD (SOUTHWEST 40 STREET) AND THE PROPERTIES
NORTH OF BIRD ROAD, ON THE EAST BY MCDONALD STREET AND MAIN
STREET, ON THE SOUTH BY MARLER AVENUE AND LOQUAT STREET, AND ON
THE WEST BY 39 AVENUE, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT
"A", ATTACHED AND INCORPORATED ("AREA"), IS A SLUM OR BLIGHTED AREA;
THAT THE REHABILITATION, CONSERVATION, AND REDEVELOPMENT OF THE
AREA IS IN THE INTEREST OF PUBLIC HEALTH, SAFETY, MORALS, AND
WELFARE OF THE RESIDENTS OF THE COUNTY, THE CITY, AND THE
RESIDENTS LIVING WITHIN THE AREA; ACCEPTING THE COUNTY'S
DELEGATION OF AUTHORITY TO CREATE A COMMUNITY REDEVELOPMENT
AGENCY TO BE KNOWN AS THE WEST GROVE COMMUNITY REDEVELOPMENT
AGENCY ("WEST GROVE CRA") WITH THE GEOGRAPHIC BOUNDARIES SET
FORTH IN EXHIBIT "A", ATTACHED AND INCORPORATED, AND AUTHORIZING A
COMMUNITY REDEVELOPMENT PLAN FOR THE AREA BE PREPARED; FURTHER,
PURSUANT TO SECTION 163.356(1), FLORIDA STATUES, DECLARING THAT
THERE IS A NEED FOR THE WEST GROVE CRA AND DECLARING THE MIAMI
CITY COMMISSION TO BE THE GOVERNING BODY OF THE WEST GROVE CRA
WHICH WILL BE A SEPARATE, DISTINCT, AND INDEPENDENT ENTITY FROM THE
CITY COMMISSION WITH ALL THE RIGHTS, POWERS, PRIVILEGES, DUTIES, AND
IMMUNITIES OF A COMMUNITY REDEVELOPMENT AGENCY AS PROVIDED FOR
IN SECTION 163.357, FLORIDA STATUTES; DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THOSE NAMED HEREIN.

WHICH WILL BE A SEPARATE, DISTINCT, AND INDEPENDENT ENTITY FROM THE
CITY COMMISSION WITH ALL THE RIGHTS, POWERS, PRIVILEGES, DUTIES, AND
IMMUNITIES OF A COMMUNITY REDEVELOPMENT AGENCY AS PROVIDED FOR
IN SECTION 163.357, FLORIDA STATUTES; DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THOSE NAMED HEREIN.
WHEREAS, the Florida Legislature enacted the Community Redevelopment Act of 1969,
which is presently codified in Chapter 163, Part III, Sections 163.330 through 163.464, Florida
Statutes ("Act"); and
WHEREAS, on January 11, 2018, the Miami City Commission adopted Resolution No.
R-18-0010, which accepted and approved the Finding of Necessity Report finding the
geographical boundaries as set forth in Exhibit "A", attached and incorporated ("West Grove
Area"), to be slum and blighted as defined by the criteria outlined in Chapter 163, Florida
Statutes; and
WHEREAS, on April 23, 2020, the City Commission adopted Resolution No. R-20-0131,
which, in part, authorized the City Manager to take all necessary steps to create a community
redevelopment agency in the West Grove Area ("West Grove CRA"); and
WHEREAS, on July 21, 2020, the Miami -Dade County ("County") Board of County
Commissioners ("County Commission"), as governing body pursuant to the Act, adopted
Resolution No. R-709-20 accepting the Finding of Necessity for the West Grove Area, declaring
the West Grove Area as slum or blighted, and delegating the power to create the West Grove
CRA to the City for the purposes of adopting a redevelopment plan to present to the County
Commission for review and approval; and
WHEREAS, the City declares a need for a West Grove CRA; and
WHEREAS, the City declares the rehabilitation, conservation, and redevelopment of the
West Grove Area to be in the interest of public health, safety, morals, and welfare of the
residents of the County, the City, and those living within the West Grove Area; and
WHEREAS, the City wishes to adopt the findings of the County and exercise its power to
create the West Grove CRA for the West Grove Area; and
WHEREAS, the City wishes to ensure the District 2 Commissioner shall be the
Chairperson of the Board of the West Grove CRA; and
WHEREAS, the City authorizes a Community Redevelopment Plan be created for the
West Grove Area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby adopts the findings of the County declaring, in
accordance with Section 163.335, Florida Statutes, the West Grove Area to be a slum and
blighted area.
Section 3. The City Commission hereby adopts the findings of the County declaring the
rehabilitation, conservation, and redevelopment of the West Grove Area to be in the interest of
public health, safety, morals, and welfare of the residents of the County, the City, and those
living within the West Grove Area.
Section 4. The City Commission declares that there is a need for the West Grove CRA
for the West Grove Area to carry out the redevelopment purposes provided for by the Act.
Section 5. The City Commission accepts the delegation of authority to create the West
Grove CRA with geographic boundaries set forth in Exhibit "A", attached and incorporated.
Section 6. Pursuant to Section 163.357, Florida Statutes, the Commissioners declares
themselves to be the governing body of the West Grove CRA with the District 2 Commissioner
as the Chairperson of the governing body, which body is separate, distinct, and independent
from the City Commission with all the rights, powers, privileges, duties, and immunities of a
Community Redevelopment Agency.
Section 7. The West Grove CRA shall have the sole power initially to prepare and adopt
a plan of redevelopment for the West Grove Area which shall be submitted to the County for the
County Commission's approval, in its sole discretion, after notice and a public hearing.
Section 8. The City Clerk is hereby directed to transmit a copy of this Resolution to the
County Commission.
Section 9. This Resolution shall become effective immediately upon its adoption.
