HomeMy WebLinkAboutAgenda Item Summary Form1IV OF 3 AGENDA ITEM SUMMARY FORM File ID: #8532 �) ;,moo x i 9 Date: 01/25/2021 Requesting Department: Department of Fire - Rescue Commission Meeting Date: 03/11/2021 Sponsored By: District Impacted: All Type: Resolution Subject: Access Contract - Cleaning and Bunker Repair Purpose of Item: The nature of this item is to establish a resolution of the of the Miami City Commission with attachments, authorizing the piggyback of the Miami -Dade County ("MDC") Contract No. FB-00664 for the provision of Cleaning and Repair of Bunker Gear, on an as needed basis, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended, with MBGC, LLC d/b/a Minerva Bunker Gear Cleaning ("MBGC"), Inc., which was competitively solicited for an initial term of five (5) years, and will expire on July 31, 2023, subject to any extensions and/or replacement contracts by MDC; allocating funds from various sources of funds and agencies, subject to the availability of funds and budgetary approval, at the time of need; authorizing the City Manager to execute the supplemental agreement, in a form acceptable to the City Attorney; further authorizing the City Manager to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations, and prior budgetary approvals, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's procurement ordinance, anti -deficiency act, and financial integrity principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: The City of Miami's Fire -Rescue Department ("Fire -Rescue") has a need for Bunker Gear Cleaning, Inspection and Repair, on as needed basis. It is required by law and is important for the health and safety of the City's firefighters. MBGC has been successfully providing this service to the City for five (5) years, however the current contract is scheduled to expire April 2021. After further market research was conducted it was determined that accessing MDC Contract No. FB-00664 for the provision of Cleaning and Repair of Bunker Gear, on an as needed basis, will reduce the City's costs due to the combined volume procured of said services by MDC and the City's Fire -Rescue. FB-00664 FOR THE PROVISION OF CLEANING, REPAIR, AND INSPECTION SERVICES FOR BUNKER GEAR, ON AN AS NEEDED BASIS, FOR THE CITY OF MIAMI'S ("CITY") FIRE -RESCUE DEPARTMENT PURSUANT TO SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), WITH MBGC, LLC, A FLORIDA LIMITED LIABILITY COMPANY ("MBGC"), WHICH WAS COMPETITIVELY SOLICITED FOR A TERM OF FIVE (5) YEARS AND IS EFFECTIVE THROUGH JULY 31, 2023; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF LEGALLY AVAILABLE FUNDS AND SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CITY'S SUPPLEMENTAL AGREEMENT WITH MBGC, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, EXTENSIONS, AND/OR REPLACEMENT CONTRACTS BY MDC, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami's ("City") Fire -Rescue Department ("Fire -Rescue") has a need for bunker gear cleaning, repair, and inspection services ("Services"); and WHEREAS, the Services are required by law and important to the health, safety, and wellbeing of the City's firefighters; and WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended ("City Code"), the City's Chief Procurement Officer has determined that Miami -Dade County ("MDC") Contract No. FB-00664 between MDC and MBGC, LLC, a Florida limited liability company ("MBGC"), was entered into pursuant to a competitive process in compliance with the City's laws, policies, and procedures; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The accessing of MDC Contract No. FB-00664 for the provision of the Services, on an as needed basis, for Fire -Rescue pursuant to Section 18-111 of the City Code with MBCG, which was competitively solicited for a term of five (5) years and is effective through July 31, 2023, is authorized. Section 3. Funding is allocated from the various sources of legally available funds and subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to execute the City's supplemental agreement with MBGC, in a form acceptable to the City Attorney. Section 5. The City Manager is further authorized' to negotiate and execute any and all other documents, including any amendments, renewals, extensions, and/or replacement contracts by MDC, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption.
