City of Miami File ID: 8443 (Revision: A) Printed On: 3/9/2021 ._� v ox w � City of Miami Q, Legislation Ordinance Enactment Number: 13970 File Number: 8443 Final Action Date: 2/25/2021 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 10/ARTICLE I/SECTION 4 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "BUILDINGS/IN GENERAL/BUILDING PERMIT FEE SCHEDULE," TO AMEND THE FEE FOR WORK STARTED WITHOUT PERMITS FOR NON- HOMESTEAD/COMMERCIAL PROPERTIES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami ("City") has a real estate market of continual development and re -development of both commercial and residential properties; and WHEREAS, the City continues to contend with the issue of contractors starting work without permits; and WHEREAS, Chapter 10, Section 10-4(b)(1)(e) of the Code of the City of Miami, Florida, as amended ("City Code"), establishes fees for work started without permits; and WHEREAS, this Section does not differentiate between fees for homesteaded properties and non-homestead/commercial properties; and WHEREAS, in order to alleviate the problem of construction work performed without permits and to better serve the community, the City wishes to establish a penalty system for those contractors performing work without permits; and WHEREAS, since 2014, the Section 109.4 of the Florida Building Code provides that fees for work commenced prior to issuance of a permit "shall be subject to a fee established by the building official that shall be in addition to the required permit fees"; and WHEREAS, this change in fee structure is in the best interests of the City and its residents to ensure that property owners and contractors obtain permits for construction work done on their premises which promotes the health, safety, and welfare of the community; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 10, Article I, Section 4 the City Code is further amended in the following particulars:' "CHAPTER 10 ' Words and/or figures stricken through shall be deleted. (1) Building, plumbing, mechanical and electrical permit fees. e. Fee for work started without permits: When work is commenced prior to obtaining a required permit, a fee of two times that specified in this section, plus a $110.00 f+4ee shall be paid for Homestead Properties, and a fee of four (4) times that specified in this Section, plus a $110.00 fee shall be paid for Non- Homestead/Commercial Properties. The payment of such fees shall not relieve any person, firm, or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The fee requirement shall be applicable to all trade divisions of the building department. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
