Subject: Execute Mutual Aid Agreement - Child Endangerment and Missing/Abducted
Children
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Mutual Aid Agreement, in substantially the attached form,
between the member agencies of the Child Abduction Response Team (CART), and the
Florida Department of Law Enforcement (FDLE), for an extended period from January
1, 2021 to December 31, 2025, to continue mutual aid in the form of law enforcement
services and resources to adequately respond to continuing, multi -jurisdictional efforts
to rescue abducted children and investigate missing endangered children cases. The
previous agreement entered into pursuant to Resolution No. 17-0081, has an expiration
date of December 31, 2020.
Background of Item:
The law enforcement agencies listed on the attached agreement have joined together in
a multi -jurisdictional effort to rescue abducted children and under circumstances
allocate their resources to missing/endangered children cases. These agencies are all
participants of a multi -agency effort known collectively as the Children Abduction
Response Team (CART). These agencies agree to utilize applicable state and federal
laws to prosecute criminal, civil, and forfeiture actions against identified violators, as
appropriate. These agencies have the authority under Part 1, Chapter 23, Florida
Statutes, "The Florida Mutual Aid Act," to enter into a voluntary agreement for
cooperation and assistance of a routine law enforcement nature that crosses
jurisdictional lines.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE MEMBER AGENCIES
OF THE CHILD ABDUCTION RESPONSE TEAM AND THE FLORIDA DEPARTMENT
OF LAW ENFORCEMENT FOR THE PERIOD BEGINNING JANUARY 1, 2021 AND
ENDING DECEMBER 31, 2025 TO RECEIVE AND EXTEND MUTUAL AID IN THE
FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ADEQUATELY
RESPOND TO CONTINUING, MULTI -JURISDICTIONAL INVESTIGATIONS OF
INCIDENTS INVOLVING CHILD ENDANGERMENT AND MISSING/ABDUCTED
CHILDREN, TO PROTECT THE PUBLIC PEACE AND SAFETY, AND TO PRESERVE
THE LIVES AND PROPERTY OF THE CITY OF MIAMI'S RESIDENTS PURSUANT TO
PART 1, CHAPTER 23, FLORIDA STATUTES.
WHEREAS, the subscribed law enforcement agencies ("Member Agencies") including
the Miami Police Department ("MPD") have joined together in a multi -jurisdictional effort to
rescue abducted children and, under certain circumstances, allocate their resources to
missing/endangered children cases; and
WHEREAS, the Member Agencies are all participants in a multi -agency effort known
collectively as the Children Abduction Response Team ("CART"); and
WHEREAS, the Member Agencies agree to utilize applicable state and federal laws to
prosecute criminal, civil, and forfeiture actions against identified violators, as appropriate; and
WHEREAS, the Member Agencies have the authority under Part 1, Chapter 23, Florida
Statutes, titled the "Florida Mutual Aid Act," to enter into a voluntary agreement for cooperation
and assistance of a routine law enforcement nature that crosses jurisdictional lines; and
WHEREAS, the Member Agencies are located in relation to each other that it is to the
advantage of each to receive and extend mutual aid in the form of law enforcement services
and resources to adequately respond to continuing, multi -jurisdictional criminal activities, to
protect the public peace and safety, and to preserve the lives and property of each Member
Agencies' residents; and
WHEREAS, additional parties, at the request and with the approval of the Florida
Department of Law Enforcement ("FDLE") and other CART members, may enter into this
Agreement at a later date as evidenced by their signing of the Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to execute a Mutual Aid Agreement,
in substantially the attached form, between the Member Agencies of CART, including the City,
and the FDLE for the period beginning January 1, 2021 and ending December 31, 2025 to
receive and extend mutual aid in the form of law enforcement services and resources to
adequately respond to continuing, multi -jurisdictional efforts to investigate incidents involving
child abduction and missing/endangered children so as to protect the public peace and safety
and to preserve the lives and property of the each Member Agencies' residents pursuant to Part
1, Chapter 23, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption.
