HomeMy WebLinkAboutR-21-0033City of Miami f Legislation Resolution: R-21-0033 File Number: 8393 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/28/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND MIAMI-DADE COUNTY ("COUNTY"), BY AND THROUGH THE MIAMI-DADE POLICE DEPARTMENT, FOR THE PURPOSE OF ENSURING DIRECT RADIO COMMUNICATIONS CAPABILITY BETWEEN EACH PUBLIC SAFETY ANSWERING POINT AND ALL FIRST RESPONDER AGENCIES WITHIN THE COUNTY IN THE EVENT OF A PUBLIC SAFETY EMERGENCY PURSUANT TO THE REQUIREMENTS OF SECTION 365.179, FLORIDA STATUTES. WHEREAS, the Marjory Stoneman Douglas High School Public Safety Commission ("Commission") recommended that counties throughout the State of Florida be required to develop and implement communication systems that allow direct radio communication between 911 public safety answering points ("PSAP") and first responders outside the PSAP's normal service area to provide for more efficient dispatch of first responders; and WHEREAS, in response to the Commission's recommendations, the Florida Legislature created Section 365.179, Florida Statutes, titled "Direct Radio Communication Between 911 Public Safety Answering Points and First Responders" ("Law"); and WHEREAS, the Law requires each sheriff in collaboration with all first responder agency heads in his or her county to facilitate the development and execution of written interlocal agreements between all primary first responder agencies within the county for purposes of coordinating and ensuring direct radio communication between each PSAP and all first responder agencies; and WHEREAS, the Miami -Dade Police Department ("MDPD") as the sheriff of Miami -Dade County ("County") is required to enter into an Interlocal Agreement with the City of Miami ("City") for the purpose of complying with the Law; and WHEREAS, Section 163.01, Florida Statutes, known as the "Florida Interlocal Cooperation Act of 1969," authorizes local governments to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage to provide services and facilities that will harmonize geographic, economic, population, and other factors influencing the needs and development of local communities; and WHEREAS, Part 1 of Chapter 163, Florida Statutes, permits public agencies, as defined therein, to enter into interlocal agreements with each other to exercise jointly any power, privilege, or authority which such agencies share in common and which each might exercise separately; City of Miami Page 1 of 2 File ID: 8393 (Revision: A) Printed On: 21812021 File ID: 8393 Enactment Number: R-21-0033 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to execute an Interlocal Agreement, in substantially the form attached, with the County for the purpose of ensuring direct radio communications capabilities between each PSAP and all first responders agencies within the County in the event of a public safety emergency pursuant to the requirements of the Law. Section 3. This Resolution shall become effective immediately upon its adoption.
