R-20-0156 ADOPTED ON MAY 14, 2020 AND EXTENDED BY RESOLUTION NO. R-20-0231 ADOPTED ON JULY 23, 2020 FROM JANUARY 31, 2021 TO SEPTEMBER 30, 2021 IN ORDER TO CONTINUE TO ASSIST STRUGGLING BUSINESSES AFFECTED BY THE NOVEL CORONAVIRUS PANDEMIC WITH ALL OTHER PROVISIONS OF SUCH PRIOR RESOLUTIONS TO REMAIN THE SAME; DIRECTING THE CITY MANAGER TO COLLABORATE WITH THE ENTITIES STATED HEREIN TO ACCOMPLISH THE GOALS SET FORTH IN THIS RESOLUTION; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. SPONSOR(S): Commissioner Joe Carollo, Commissioner Ken Russell, Commissioner Manolo Reyes WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida Statutes, Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12, 2020 that a State of Local Emergency exists within the City in response to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes, the Mayor has presently extended the State of Local Emergency for additional seven (7) day periods; and WHEREAS, on May 20, 2020, the City Commission adopted Resolution No. R-20-0156 to assist businesses negatively affected by the COVID-19 pandemic by authorizing the City Manager to identify feasible portions of City rights -of -way that may be repurposed for pedestrian and sidewalk cafe usage and to take any and all steps necessary to effectuate such repurposing until August 20, 2020 ("COVID-19 Restaurant Recovery Program"); and WHEREAS, on July 23, 2020, the City Commission adopted Resolution No. R-20-0231, which extended the COVID-19 Restaurant Recovery Program until January 31, 2021; and WHEREAS, the City Commission wishes to extend the COVID-19 Restaurant Recovery Program until September 30, 2021 in order to continue to assist struggling businesses and prohibit the imposition of fees related to the same; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. The COVID-19 Restaurant Recovery Program created by Resolution No. R- 20-0156 adopted on May 14, 2020 and extended by Resolution No. R-20-0231 adopted on July 23, 2020, which provided for an expiration date the program of January 31, 2021, is hereby extended until September 30, 2021 in order to continue to assist struggling businesses affected by the COVID-19 pandemic with all other provisions of such prior Resolutions to remain the same provided that no fees may be imposed in connection with this program. Section 3. In addition to the Miami Parking Authority, the Miami Police Department, the Coconut Grove Business Improvement District, and the Wynwood Business Improvement District, the City Manager is directed to collaborate with the Downtown Development Authority and any other relevant and necessary entities to accomplish the goals set forth by the Resolution creating the COVID-19 Restaurant Recovery Program. Section 4. The City Clerk is directed to transmit a certified copy of this Resolution to the Miami -Dade County ("County") Board of County Commissioners, the County Mayor, the Director of the County's Department of Transportation and Public Works, and the Florida Department of Transportation District Six Secretary. Section 5. This Resolution shall become effective immediately upon its adoption.
