Santana, Agenda Coordinator cc_ Annie Perez, CPPO, Director of Procurement Anthony Barcena, Assistant Director of Real Estate & Asset Management Attachn-ent CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on Thursday, January 14, 2021 at 9:00 a.m., in the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida 33133, for the purpose of granting the following: A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A", PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY") FOR THE PROVISION OF MANAGEMENT AND LEASING SERVICES BY NAI MIAMI PROPERTY MANAGEMENT, LLC ("NAI"), AS APPROVED BY CITY COMMISSION; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A TEMPORARY MANAGEMENT AGREEMENT ("MANAGEMENT AGREEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI ("CITY") AND NAI, WHEREBY NAI SHALL MANAGE AND LEASE THE RESIDENTIAL APARTMENTS AND RETAIL COMPONENTS, AND PROVIDE CARETAKER SERVICES OF THE THEATER COMPONENT, OF THE CITY -OWNED PROPERTY LOCATED AT 174 EAST FLAGLER STREET, MIAMI, FLORIDA, AND KNOWN AS THE OLYMPIA THEATER, AS MORE PARTICULARLY DESCRIBED IN THE NAI PROPOSAL, FOR A MANAGEMENT FEE TO BE NEGOTIATED, BUT IN NO EVENT GREATER THAN THE AMOUNT PROVIDED IN THE NAI PROPOSAL, AND INCLUDING A NINETY -DAY OPTION TO TERMINATE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS SUBJECT TO ALLOCATIONS, APPROPRIATIONS AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ("CITY CODE"), INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI - DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR SAID PURPOSE. All interested persons are invited to appear at the meeting and may be heard with respect to the proposed ordinance. Should any person desire to appeal any decision of the City Commission with respect to any matter to be considered at this meeting, that person shall ensure that a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based (F.S. 286.0105).
