R-20-0237 AND ON SEPTEMBER 24, 2020 PURSUANT TO RESOLUTION NO. R-20- 0293, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO PROVIDE MORTGAGE PAYMENT ASSISTANCE UTILIZING CORONAVIRUS RELIEF FUNDS FROM THE UNITED STATES TREASURY DEPARTMENT THROUGH THE FLORIDA HOUSING FINANCE CORPORATION IN CONFORMITY WITH THE LOCAL HOUSING ASSISTANCE PLAN; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. SPONSOR(S): Mayor Francis X. Suarez WHEREAS, on July 23, 2020, pursuant to Resolution No. R-20-0237, the City Commission approved the acceptance of $1,312,500.00, which included an amount of $1,181,250.00 to be used for mortgage assistance for homeowners with loss or reduction in income by creating and funding the City of Miami's ("City") Mortgage Assistance Program ("Program"); and WHEREAS, on September 24, 2020, pursuant to Resolution No. R-20-0293, the City Commission approved increasing the limit per recipient of the Program from $6,000.00 to $10,000.00; and WHEREAS, on October 8, 2020, pursuant to Resolution No. R-20-0313, the City Commission approved an additional allocation of Coronavirus Relief Funds ("CRF") in the total amount of $787,500.00, which included an amount of $708,750.00 to the Program; and WHEREAS, to expand the number of eligible applicants for the Program, the Florida Housing Finance Corporation (THFC") has changed its requirements regarding income limits for the use of CRF and has advised the City that there is no need to place limits on the amount of mortgage payments that can be paid as part of the Program; and WHEREAS, as a result of the aforementioned changes, the City is amending the required area median income ("AMI") for eligible applicants to up to 140% of AMI and is removing limits on the amount of mortgage payments that can be paid as part of the Program; and WHEREAS, the City's Administration recommends amending the Program guidelines adopted on July 23, 2020 pursuant to Resolution No. R-20-0237 and on September 24, 2020 City of Miami Page 1 of 2 File ID: 8351 (Revision:) Printed On: 11512021 File ID: 8351 Enactment Number: R-20-0414 pursuant to Resolution No. R-20-0293 to provide mortgage payment assistance utilizing CRF from the United States Treasury Department ("Treasury") through FHFC to help more City residents currently suffering from the economic hardships caused by the Coronavirus pandemic; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The amendment of the Program guidelines adopted on July 23, 2020 pursuant to Resolution No. R-20-0237 and on September 24, 2020 pursuant to Resolution No. R-20-0293, as more particularly described in Exhibit "A," attached and incorporated, to provide mortgage payment assistance utilizing CRF from the Treasury through FHFC in conformity with the Local Housing Assistance Plan is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption.
