A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO REIMBURSE ALL ELIGIBLE EXPENSES UNDER THE CITY OF
MIAMI'S RENTAL ASSISTANCE AND EVICTION PREVENTION PROGRAMS FROM
CORONAVIRUS RELIEF FUND FUNDS FROM THE UNITED STATES TREASURY
DEPARTMENT THROUGH THE FLORIDA HOUSING FINANCE CORPORATION;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS,
EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND
LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS.
WHEREAS, on July 23, 2020, pursuant to Resolution No. 20-0237, the City Commission
approved the acceptance of $1,312,500.00, which included an amount of $1,181,250.00 to be
used for mortgage assistance for homeowners with loss or reduction in income by creating and
funding the City of Miami's ("City") Mortgage Assistance Program ("Program"); and
WHEREAS, on September 24, 2020, pursuant to Resolution No. 20-0293, the City
Commission approved increasing the limit recipients can receive from the Program from
$6,000.00 to $10,000.00; and
WHEREAS, on October 8, 2020, pursuant to Resolution No. 20-0313, the City
Commission approved an additional allocation of Coronavirus Relief Funds ("CRF") in the total
amount of $787,500.00, which included an amount of $708,750.00 for the Program; and
WHEREAS, as of November 30, 2020, 92 households have been approved out of the
240 households that applied for the Program for an amount of $675,824.00; and
WHEREAS, approximately another $150,000.00 is projected to be spent before
December 30, 2020 for a total expenditure of approximately $830,824.00, which would leave a
balance of approximately $1.2 million unspent; and
WHEREAS, the Florida Housing Finance Corporation (THFC") has advised the City that
all Coronavirus rental assistance programs are eligible for the unspent funds and, therefore, all
eligible expenditures for such rental assistance programs can be reimbursed using the CRF
from the State of Florida; and
WHEREAS, the City's Administration recommends the use of CRF from the United
States Treasury Department ("Treasury") through FHFC to reimburse all eligible expenses
incurred for the Rental Assistance and Eviction Prevention programs through December 30,
2020; and
WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida,
as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an
emergency nature;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The use of CRF from the Treasury through FHFC to reimburse all eligible
expenses incurred for the Rental Assistance and Eviction Prevention programs through
December 30, 2020 is authorized.'
Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including amendments, extensions, and modifications, all in forms
acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use
of such funds, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
