WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Planning and Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required," temporary events are limited to no more than two (2) events per year per property, for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, the property located at 2805 Southwest 32 Avenue, Miami, Florida ("Property") wishes to have a temporary event from December 11, 2020 to December 31, 2020 for the sale of fireworks for New Year's Eve celebrations ("Event"); and WHEREAS, the Event will require permits to be issued by the City of Miami ("City") to ensure life -safety and quality of life issues and appropriate conditions may be imposed on each permit; and WHEREAS, the Event at the Property will be beneficial to the City's residents; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Planning and Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required," the two (2) temporary event per year, per property limitation is hereby waived to allow the Event at the Property starting December 11, 2020 and ending December 31, 2020. Section 3. This Resolution does not waive any other requirements of the City Code, including but not limited to, applicable fees, inspections, and permits. Section 4. This Resolution shall become effective immediately upon its adoption.
