HomeMy WebLinkAboutR-20-0385City of Miami f Legislation Resolution: R-20-0385 File Number: 8039 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 11/19/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") AND WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 3 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE FUND IN A TOTAL AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY THREE THOUSAND NINE HUNDRED FORTY THREE DOLLARS AND SIX CENTS ($123,943.06) TO CATHOLIC CHARITIES OF THE ARCHDIOCESE OF MIAMI, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("CATHOLIC CHARITIES"), IN SUPPORT OF CATHOLIC CHARITIES' SERVICES FOR THE ELDERLY AT THE MYERS SENIOR CENTER; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Catholic Charities of the Archdiocese of Miami, Inc., a Florida not for profit corporation ("Catholic Charities"), is seeking funding in support of services provided for the elderly at the Myers Senior Center where Catholic Charities will serve thirty (30) breakfasts and forty five (45) hot lunches daily ("Program"); and WHEREAS, it is requested that the City Commission allocate funds from the District 3 share of API funds in an amount not to exceed One Hundred Twenty Three Thousand Nine Hundred Forty Three Dollars and Six Cents ($123,943.06) ("Funds") for the Program; and WHEREAS, the District 3 Commissioner wishes to provide the Funds to further assist the elderly participants of the Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Exhibit "A", that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program and, therefore, such City of Miami Page 1 of 2 File ID: 8039 (Revision: A) Printed On: 1212812020 File ID: 8039 Enactment Number: R-20-0385 methods and procedures should be waived; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for said allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A", that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate the Funds from the District 3 share of the City's API to Catholic Charities. Section 4. The City Manager is further authorized' to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
