ABC Promotions applies annually for a Temporary Event Permit for the sale of
Christmas Trees and Sparklers at 3701 Northwest 7th St. Their event is beyond the 28
days allowed per code and as a result requires City Commission approval to waive the
temporary event limitation to extend their event through December 31st.

A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2)
TEMPORARY EVENT LIMITATION PER YEAR FOR A PRIVATE PROPERTY
PURSUANT TO SECTION 62-521(B)(4) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, TO ALLOW THE PROPERTY AT 3701 NORTHWEST 7TH
STREET, MIAMI, FLORIDA TO HOST TEMPORARY EVENTS CONSISTING OF THE
SALE OF CHRISTMAS TREES AND SPARKLERS BEGINNING NOVEMBER 20, 2020
AND ENDING DECEMBER 31, 2020.
WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as
amended ("City Code"), titled "Temporary Events in General," temporary events are limited to
no more than two (2) events per year per property for a maximum of two (2) weeks per permit;
and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events
can be waived upon affirmative vote of the City Commission; and
WHEREAS, the property located at 3701 Northwest 7th Street, Miami, Florida
("Property") wishes to have temporary events from November 20, 2020 to December 31, 2020
for the temporary sale of Christmas trees and sparklers; and
WHEREAS, the events will require permits to be issued by the City of Miami ("City") to
ensure life -safety and quality of life issues and appropriate conditions may be imposed on each
permit; and
WHEREAS, the proposed temporary events at the above location will be beneficial to
the City's residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, the two (2) temporary
event per year per property limitation is hereby waived to allow the temporary sale of Christmas
trees and sparklers at the Property beginning November 20, 2020 and ending December 31,
2020.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption.
