Background of Item: On December 12, 2019, City Commission directed the City Manager and City administration to conduct a comprehensive review the City's Zoning Ordinance, Miami 21, and deliver a Miami 21 Code Report ("Report"). To assist in that effort, Commission created a 12-member task force called the Miami 21 Report Ad Hoc Task Force ("Task Force"). Due to several unexpected complexities associated with the Task Force, including the challenge of holding meetings during COVID-19, the original 180-day deadline for the Report is untenable. The Planning Department is confident that an extension to the second Commission meeting in June of 2021 is sufficient time to complete and deliver the Report. R- 19-0523 ADOPTED ON DECEMBER 12, 2019, TO WORK WITH THE CITY OF MIAMI ("CITY") DEPARTMENTS AND THE MIAMI 21 TASK FORCE TO CONDUCT A COMPREHENSIVE REVIEW OF ORDINANCE NO. 13114, THE ZONING CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), EVALUATE THE DEVELOPMENT DIRECTION OF THE CITY, ISSUE A MIAMI 21 CODE REPORT, AND REPORT TO THE CITY COMMISSION THE FINDINGS, RECOMMENDATIONS, AND PROPOSED CHANGES TO THE MIAMI 21 CODE TO THE JUNE 24, 2021 CITY COMMISSION MEETING. WHEREAS, pursuant to Resolution No. R-19-0523 adopted on December 12, 2019, the City Commission directed the City Manager to work with the City Administration and the Miami 21 Report Ad Hoc Task Force ("Miami 21 Task Force") to conduct a comprehensive review of of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code"); evaluate the development direction of the City of Miami ("City"); issue a Miami 21 Code Report; and report to the City Commission findings, recommendations, and proposed changes to the Miami 21 Code within one hundred eighty (180) days; and WHEREAS, pursuant to Resolution No. R-20-0015 adopted on January 23, 2020, the City Commission established the Miami 21 Task Force and members were subsequently appointed; and WHEREAS, on March 12, 2020, Mayor X. Francis Suarez declared a local State of Emergency due to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, pursuant to Ordinance No. 13902 adopted on May 28, 2020, the City Commission tolled the time period to present to the City Commission the Miami 21 Code Report, findings, recommendations, and proposed changes to the City Commission due to the COVID-19 pandemic retroactively to March 12, 2020; and WHEREAS, pursuant to Ordinance No. 13921 adopted by the City Commission on September 24, 2020, the tolling period ceased on September 24, 2020; and WHEREAS, the deadline to submit the Miami 21 Code Report, findings, recommendations, and proposed changes to the City Commission is December 22, 2020; and WHEREAS, pursuant to Resolution No. R-20-0320 adopted on October 8, 2020, the City Commission re-established the Miami 21 Task Force due to unexpected issues that arose; and WHEREAS, members are currently being appointed to the Miami 21 Task Force and the newly created Miami 21 Task Force is expected to begin meeting in December 2020; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Commission hereby extends the time period for the City Administration, pursuant to Resolution No. R-19-0523, to work with the City's Departments and the Miami 21 Task Force to conduct a comprehensive review of the Miami 21 Code; evaluate the development direction of the City; issue a Miami 21 Code Report; and report to the City Commission findings, recommendations, and proposed changes to the Miami 21 Code to the June 24, 2021 City Commission meeting. Section 3. This Resolution shall become effective immediately upon its adoption.
