HomeMy WebLinkAboutO-13946City of Miami l i , J'f Legislation Ordinance: 13946 File Number: 7885 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 11/19/2020 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING ARTICLE 5, SECTION 5.3.4, TITLED "PARKING STANDARDS J3)", TO PROVIDE PROPORTIONAL DRIVEWAY WIDTH REGULATIONS FOR LOW DENSITY RESIDENTIAL PROPERTIES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. SPONSOR(S): Commissioner Keon Hardemon WHEREAS, the Planning, Zoning and Appeals Board (TZAB"), at its meeting on October 7, 2020 following an advertised public hearing, adopted Resolution No. PZAB-R-20 - 037 by a vote of seven to zero (7 — 0) Item No. 2, recommending approval of the proposed Miami 21 Code text amendment; and WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114 as the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and WHEREAS, the Miami 21 Code seeks to minimize the impact of automobile parking and driveways on the pedestrian environment and adjacent properties, especially within low density residential areas; and WHEREAS, for pedestrian and vehicular safety, it is important to minimize conflicts created by driveways as they enfront residential streets; and WHEREAS, it is desirable to minimize off-street parking adjacent to a thoroughfare front; and WHEREAS, it is best to accommodate vehicles on -site and avoid parking spillover onto public rights -of -way; and WHEREAS, larger lots can proportionately accommodate ampler driveways while retaining the desirable pervious and landscaped areas appropriate for low density residential areas; and WHEREAS, the City Commission has given full consideration to the Planning Director's recommendations as to this proposed text amendment; and WHEREAS, the City Commission has held a public hearing on the proposed text amendment; and WHEREAS, the City Commission has considered whether the proposed text amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City of Miami regulations; and City of Miami Page 1 of 3 File ID: 7885 (Revision:) Printed On: 121112020 File ID: 7885 Enactment Number: 13946 WHEREAS, the City Commission has considered the need and justification for the proposed text amendment, including changed or changing conditions that make the passage of the proposed text amendment necessary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Article 5 of the Miami 21 Code is further amended in the following particulars:' "ARTICLE 5. DEFINITIONS SECTION 5.3.4 PARKING STANDARDS (T3) a. Vehicular parking shall be required as shown in Article 4, Tables 4 and 5. b. Parking may be accessed by an Alley when such is available. c. Covered parking and garages and at least fifty percent (50%) of required parking shall be located within the Second and Third Layers as shown in Article 4, Table 8; in T3-R and T3-L a maximum thirty percent (30%) of the width of the Facade may be covered parking or garage. In T3-0 covered parking and garages shall be a maximum sixty percent (60%) of the width of the fagade. Covered parking and garages shall align with or be set back from the Facade. Driveways and drop-offs including parking may be located within the First Layer. d. The maximum width at the Property Line of a Driveway on a Frontage shall be twelve (12) feet for T3-R and T3-L and twenty (20) feet for T3-0. For Lots exceeding fifty (50) feet width on a Frontage which provide a single access point, the maximum Driveway width at the Property Line shall be twenty percent (20%) of the Property Line not to exceed twenty (20) feet. Two separate Driveways on one Lot shall have a minimum separation of twenty (20) feet in T3-R and T3-L only. e. Tandem Parking on site is encouraged. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance should not be affected. Section 4. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami, Florida, which ' Words and/or figures stricken through shall be deleted. Section 5.
