Purpose of Item:
The purpose of this item is to waive the two (2) temporary event limitation per year for
private property pursuant to section 62-521(b)(4) of the Code of the City of Miami,
Florida, as amended ("City Code") to allow the Sale of Christmas Trees at 2805
Southwest 32nd Avenue, Miami, Florida, beginning November 23, 2020 and ending
December 18, 2020.
Background of Item:
The Boys and Girls Club of Miami -Dade applies annually for a Temporary Event Permit
for the sale of Christmas Trees at 2805 Southwest 32nd Ave. This event exceeds the
two (2) temporary event limitation per year for private property, because a fourteen (14)
day Firework Sale was approved on the same site for the 4th of July holiday. As a
result, this event requires City Commission approval to waive the temporary event
limitation to extend their event through December 18th.

A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2)
TEMPORARY EVENT LIMITATION PER YEAR FOR A PRIVATE PROPERTY
PURSUANT TO SECTION 62-521(B)(4) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, TO ALLOW THE PROPERTY AT 2805 SOUTHWEST 32ND
AVENUE, MIAMI, FLORIDA TO HOST TEMPORARY EVENTS CONSISTING OF THE
SALE OF CHRISTMAS TREES BEGINNING NOVEMBER 23, 2020 AND ENDING
DECEMBER 18, 2020.
WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as
amended ("City Code"), titled "Temporary Events in General," temporary events are limited to
no more than two (2) events per year per property, for a maximum of two (2) weeks per permit;
and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events
can be waived upon affirmative vote of the City Commission; and
WHEREAS, the property located at 2805 Southwest 32nd Avenue, Miami, Florida
("Property") wishes to have temporary events from November 23, 2020 to December 18, 2020
for the sale of Christmas trees ("Event"); and
WHEREAS, the Event will require permits to be issued by the City of Miami ("City") to
ensure life -safety and quality of life issues and appropriate conditions may be imposed on each
permit; and
WHEREAS, the proposed Event at the Property will be beneficial to the City's residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, the two (2) temporary
event per year per property limitation is hereby waived to allow the Event at the Property
beginning November 23, 2020 and ending December 18, 2020.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption.
