HomeMy WebLinkAboutR-20-0350City of Miami f Legislation Resolution: R-20-0350 File Number: 8038 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/22/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO PLAN AND DEVELOP ANY NECESSARY IMPLEMENTATION TOOLS, POLICIES, FRAMEWORKS, AND REGULATIONS TO EXPEDITE AND FACILITATE THE CONSTRUCTION OF A CONNECTED BAYWALK AND RIVERWALK FOR PRESENTATION TO THE CITY COMMISSION WITHIN NINETY (90) CALENDAR DAYS OF THE EFFECTIVE DATE OF THIS RESOLUTION FOR CONSIDERATION AND FURTHER ACTION BY THE CITY COMMISSION. SPONSOR(S): Commissioner Ken Russell, Commissioner Manolo Reyes WHEREAS, Sections 3(mm)(ii)-(iv) of the Charter of the City of Miami, Florida, as amended ("City Charter'), and Section 3.11 of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), set standards for and require the construction of a Baywalk or Riverwalk, open to public access at all times, for new construction or when fifty percent (50%) or more of the square footage of an existing structure is altered along the waterfront abutting Biscayne Bay and the Miami River (collectively "Baywalk"); and WHEREAS, absent an application for a building permit that would require the construction of a Baywalk, an owner of land located on the specified waterfront has no duty to hold the land open to others to traverse; and WHEREAS, certain sites subject to these requirements have not yet engaged in development activities creating gaps in the Baywalk system in the City of Miami ("City"); and WHEREAS, development of a Baywalk on these properties will aid in closing the gaps present in the Baywalk and will allow for the use and enjoyment of the Baywalk by the public; and WHEREAS, with the risk of storm surge and sea level rise, the Baywalk can function as a barrier to mitigate the damaging effects that result; and WHEREAS, the City Commission wishes to create a framework to facilitate and expedite the construction of a connected Baywalk throughout the City; and WHEREAS, the City Commission wishes to direct the City Manager to study and recommend the best framework, timeline, and budget to facilitate and expedite the construction of a fully connected Baywalk throughout the City; and WHEREAS, the City Manager is directed to work and cooperate with the Miami Downtown Development Authority of the City of Miami, Florida to develop the framework to ensure a consistent, uniform, and cohesive Baywalk; and City of Miami Page 1 of 2 File ID: 8038 (Revision: A) Printed On: 1112312020 File ID: 8038 Enactment Number: R-20-0350 WHEREAS, in developing a framework, both permanent and temporary, the City Manager should consider any and all available options including, but not limited to, easements, restrictive covenants, legislation, public benefits incentives, dedications, deeds, and eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission directs the City Manager to take any and all actions necessary to plan and develop any necessary implementation tools, policies, frameworks, and regulations to expedite and facilitate the construction of a connected Baywalk for presentation to the City Commission within ninety (90) calendar days of the effective date of this Resolution for consideration and further action by the City Commission. Section 3. This Resolution shall become effective immediately upon its adoption.
