HomeMy WebLinkAboutR-20-0344City of Miami f Legislation Resolution: R-20-0344 File Number: 7857 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/22/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ALLOCATING PROGRAM INCOME FROM HOME INVESTMENT PARTNERSHIP ("HOME") PROGRAM FUNDS GENERATED FROM FEBRUARY 1, 2020 TO JULY 31, 2020 IN THE TOTAL AMOUNT OF $193,998.06 TO THE CATEGORIES SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING ANY AND ALL AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. WHEREAS, the Department of Housing and Community Development ("Department") receives various types of repayments from loans provided to developers and homeowners, which are often referred to as program income, that are required to be used for eligible program activities; and WHEREAS, from February 1, 2020 to July 31, 2020, the Department collected $193,998.06 in Home Investment Partnership ("HOME") program income; and WHEREAS, pursuant to HOME regulation 24 CFR Part 92.503, program income must be used for eligible HOME activities; and WHEREAS, the City of Miami's Administration recommends the allocation of the program income generated from February 1, 2020 to July 31, 2020 in the total amount of $193,998.06 as more particularly specified in Exhibit "A," attached and incorporated, for eligible HOME activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of HOME program income from February 1, 2020 to July 31, 2020 in the amount of $193,998.06 to the categories specified in Exhibit "A," attached and incorporated, is authorized.' ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. The City Manager is authorized' to negotiate and execute any and all necessary documents, including any and all amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds, for said purpose. Section 4.
