HomeMy WebLinkAboutR-20-0312City of Miami 1 i.RR .I Legislation alldl 1lm Resolution: R-20-0312 File Number: 7805 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/8/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), TRANSFERRING COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") FUNDS IN THE AMOUNT OF $1,574,636.20 AS WELL AS THE AMOUNT OF $99,820.80 FROM THE PREVIOUS YEAR'S PROGRAM INCOME, FOR A TOTAL AMOUNT OF $1,674,457.00, FROM THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT ("DEPARTMENT") TO THE AGENCIES SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, FOR PUBLIC SERVICE ACTIVITIES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. R-19-0500 adopted on December 12, 2019, the City Commission allocated Community Development Block Grant ("CDBG") program income in the total amount of $544,845.98, which included an amount of $81,726.89 in Public Service activities; and WHEREAS, pursuant to Resolution No. R-20-0101 adopted on April 9, 2020, the City Commission allocated CDBG program income in the total amount of $120,626.08, which included an amount of $18,093.91 in Public Service activities; and WHEREAS, pursuant to Resolution No. R-20-0212 adopted on July 23, 2019, the City Commission allocated CDBG funds in the Public Service category for program year 2020-2021, which included an amount of $1,574,636.20, to the Department of Housing and Community Development ("Department"); and WHEREAS, there is a need to allocate funds to the agencies specified in Exhibit "A," attached and incorporated, for Public Service activities; and WHEREAS, due to the Novel Coronavirus ("COVID-19") pandemic, the City of Miami ("City") has allocated more than the fifteen percent (15%) Public Service allocation cap as allowed by the Coronavirus Aid, Relief, and Economic Security Act ("CARES Act") to provide resources to agencies to assist the City's residents in COVID-19 recovery efforts; and WHEREAS, the City's Administration recommends transferring CDBG funds in the amount of $1,574,636.20 as well as the amount of $99,820.80 from the previous year's program income, for a total amount of $1,674,457.00, from the Department to the agencies specified in Exhibit "A," attached and incorporated, for Public Service activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 7805 (Revision: A) Printed On: 1012912020 File ID: 7805 Enactment Number: R-20-0312 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of CDBG funds in the amount of $1,574,636.20 as well as the amount of $99,820.80 from the previous year's program income, for a total amount of $1,674,457.00, from the Department to the agencies specified in Exhibit "A," attached and incorporated, for Public Service activities is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including but not limited to amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i 4naindez, City Attor iey 10/2212020 'The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
