SILTED WASTEWATER INTO THE CITY'S STORMWATER MANAGEMENT SYSTEM;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 49 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"),
TITLED "SEWERS AND SEWAGE DISPOSAL," IN ORDER TO DELETE OBSOLETE
REFERENCES TO THE CITY OF MIAMI'S ("CITY") FORMER SANITARY SEWER
SYSTEM AND UPDATE REFERENCES TO THE CITY'S CURRENT STORMWATER
MANAGEMENT SYSTEM; PROVIDING FOR A LIMITATION ON DISCHARGING
SILTED WASTEWATER INTO THE CITY'S STORMWATER MANAGEMENT SYSTEM;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, Chapter 49 of the Code of the City of Miami, Florida, as amended ("City
Code"), establishes regulations for discharge into storm and sanitary sewers and sewage
disposal; and
WHEREAS, the City of Miami ("City") no longer operates sanitary sewers but continues
to operate and maintain storm sewers; and
WHEREAS, it is necessary to delete obsolete references in the City Code to the City's
former sanitary sewers while updating the regulations prohibiting discharge to the City's
stormwater management system;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 49 of the City Code, titled "Sewers and Sewage Disposal", is further
amended in the following particulars:'
"CHAPTER 49
SANITARY SEWERS, STORMWATER MANAGEMENT SYSTEM, AND SEWAGE DISPOSAL
Sec. 49-2. Liquid products of petroleum not to be allowed to escape into sewers.

added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanaed material.

It shall be unlawful for any person to permit any liquid product of petroleum to escape
into aRY P611910G d the City's stormwater management system or any sanitary sewer within the
city.
Sec. 49-4. Discharge of wastewater or other non -potable fluids into city stover stormwater
management system regulated.
It shall be illegal to discharge wastewater (including wastewater with a turbidity of 29
Nephelometric Turbidity Units (NTUs) or greater), stormwater, or groundwater from a
construction excavation or other non -natural sources into a the city's star stormwater
management system 4#+kunless the rules, regulations, and requirements of the resilience and
public works department governing such discharge have been fulfilled and a permit has been
obtained from such department allowing same.
Sec. 49-5. Discharge or dumping of septic tank contents into city storm er sewers

Sec. 4946. Sinks and adequate facilities for disposal of human excreta required.
Every residence, store, establishment, building or place in the city where human beings
reside, stay, are employed or are congregated shall have a sink for wash water, and shall have
adequate facilities, approved by the county health director, for the disposal of human excreta.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 4. This Ordinance shall become effective immediately upon its adoption and
signature of the Mayor.2
2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission.
