AMENDED ("CITY CODE"), WHICHEVER IS SOONER, SUBJECT TO THE
ISSUANCE OF AN EMERGENCY ORDER BY THE MAYOR OF MIAMI-DADE
COUNTY MODIFYING OR REPEALING MIAMI-DADE COUNTY EMERGENCY
ORDER NO. 05-20 TO ALLOW THE PILOT PROGRAM TO RESUME; FURTHER
PROVIDING FOR PAYMENT OF REQUIRED EXTENSION FEES BY PILOT
PROGRAM OPERATORS PURSUANT TO SECTION 8-11(D) OF THE CITY CODE AT

A RESOLUTION OF THE MIAMI CITY COMMISSION EXTENDING THE CITY OF
MIAMI'S MOTORIZED SCOOTER PILOT PROGRAM ("PILOT PROGRAM") UNTIL
THE EXECUTION AND ROLLOUT OF THE PERMANENT MOTORIZED SCOOTER
PROGRAM OR UNTIL THE END OF THE PILOT PROGRAM PERIOD ESTABLISHED
BY SECTION 2-33(C)(9) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), WHICHEVER IS SOONER, SUBJECT TO THE
ISSUANCE OF AN EMERGENCY ORDER BY THE MAYOR OF MIAMI-DADE
COUNTY MODIFYING OR REPEALING MIAMI-DADE COUNTY EMERGENCY
ORDER NO. 05-20 TO ALLOW THE PILOT PROGRAM TO RESUME; FURTHER
PROVIDING FOR PAYMENT OF REQUIRED EXTENSION FEES BY PILOT
PROGRAM OPERATORS PURSUANT TO SECTION 8-11(D) OF THE CITY CODE AT
SUCH TIME.
WHEREAS, pursuant to Ordinance No. 13795 adopted on October 11, 2018, the City
Commission established a Motorized Scooter Pilot Program ("Pilot Program") within City of
Miami ("City") Commission District 2 for a period of six (6) months from October 1, 2018 to April
1, 2019; and
WHEREAS, due to permitting, information technology, technical, and other issues, the
rollout for the Pilot Program commenced April 1, 2019 with an expiration six (6) months
thereafter on October 1, 2019; and
WHEREAS, pursuant to Ordinance No.13862 adopted on September 26, 2019 and
Resolution No. R-19-0520 adopted December 12, 2019, the Pilot Program was extended to
February 14, 2020; and
WHEREAS, on February 13, 2020, the City Commission adopted Resolution No. R-20-
0040 extending the Pilot Program to April 15, 2020 in order to provide the City's Administration
the time necessary for a thorough and competitive sealed solicitation process for the
establishment of a permanent Motorized Scooter Program ("Permanent Program"); and
WHEREAS, the process to create a Permanent Program through a competitive
solicitation is ongoing; and
WHEREAS, pursuant to Section 2-33(c)(9) of the Code of the City of Miami, Florida, as
amended ("City Code"), the City Commission may create pilot programs within the City for a
limited period of time not to exceed one (1) year with a possible extension for an additional one
(1) year period; and
WHEREAS, on March 18, 2020, Miami -Dade County Mayor Carlos Gimenez ("County
Mayor") enacted Miami -Dade County Emergency Order No. 05-20 prohibiting the use or
placement in the public right-of-way of "any common use moped, common use motorized
scooter, common use motorized bicycle, common use bicycle, or micromobility device ... within
Miami -Dade County" due to the State of Local Emergency created by the Novel Coronavirus
("COVID-19") pandemic; and
WHEREAS, it is anticipated that the County Mayor will enact a new emergency order
allowing for the resumption of use of motorized scooters in the near future; and
WHEREAS, pursuant to Section 8-19 of the City Code, any further extension of this Pilot
Program may be approved by Resolution subject to the provisions of Section 2-33(c)(9) of the
City Code; and
WHEREAS, from March 18, 2020 to the anticipated future enactment date of a Scooter
Order by the County Mayor, the Pilot Program's motorized scooters were not available to the
general public meaning that such time does not count towards the Pilot Program's two (2) year
maximum time limitation; and
WHEREAS, City Commission wishes to extend the Pilot Program until the execution and
rollout of the Permanent Program or until the end of the Pilot Program pursuant to Section 2-
33(c)(9) of the City Code as described above, whichever is sooner; and
WHEREAS, such extension shall begin upon the County Mayor allowing motorized
scooters on the streets and is subject to payment of required extension fees by motorized
scooter Pilot Program operators pursuant to Section 8-11(d) of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The extension of the Pilot Program until the execution and rollout of the
Permanent Program or until the end of the Pilot Program pursuant to Section 2-33(c)(9) of the
City Code as described above, whichever is sooner, is hereby approved subject to the issuance
of an emergency order by the County Mayor modifying or repealing Miami -Dade County
Emergency Order No. 05-20 to allow the Pilot Program to resume, subject to payment of
required extension fees by motorized scooter Pilot Program operators pursuant to Section 8-
11(d) of the City Code at such time.
Section 3. This Resolution shall become effective immediately upon its adoption.
