Date: 07/28/2020 Requesting Department: Department of Procurement Commission Meeting Date: 09/24/2020 Sponsored By: District Impacted: All Type: Resolution Subject: Authorize Access - Miami Dade County Catering Contract Purpose of Item: The nature of this item is to authorize a resolution of the City of Miami Commission, authorizing the accessing of Miami -Dade County ("MDC") Pre -Qualification Pool Contract No. RTQ-00310 for Catering Services Citywide, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended ("City Code"), with various pre - qualified pool of vendors, which was competitively solicited and is effective through February 28, 2024" subject to any renewals, extensions and/or replacement contracts by MDC; allocating funds of various sources of funds from the user departments and agencies, subject to availability of funds and budgetary approval at the time of need; authorizing the City Manager to execute the Supplemental Agreement to contract RTQ- 00310 in substantially the attached form, further authorizing the City Manager to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: The City of Miami ("City") has a need for the provision of food catering services, Citywide. By accessing MDC Contract No. RTQ-00310 - Catering Services, it will enable the City to procure said services, at a fair competitive rate that is acceptable to the City. This contract has a term of of the ninety-six (96) months, and will expire February 28, 2024. RTQ-00310 FOR CATERING SERVICES ("CONTRACT") FOR CITYWIDE USE PURSUANT TO SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), WITH VARIOUS PRE -QUALIFIED VENDORS, WHICH WAS COMPETITIVELY SOLICITED AND IS EFFECTIVE THROUGH FEBRUARY 28, 2024, SUBJECT TO ANY RENEWALS, EXTENSIONS, AND/OR REPLACEMENT CONTRACTS BY THE COUNTY; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS FROM THE END USER DEPARTMENTS AND AGENCIES, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CITY OF MIAMI'S ("CITY") SUPPLEMENTAL AGREEMENT TO THE CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") seeks to access Miami -Dade County ("County") Pre -Qualification Pool Contract No. RTQ-00310 for Catering Services with various pre -qualified vendors, which was competitively solicited and is effective through February 28, 2024 ("Contract"); and WHEREAS, the accessing of the Contract will enable City departments to procure catering services Citywide at a fair and competitive rate acceptable to the City; and WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended ("City Code"), the City's Chief Procurement Officer has determined that the Contract was entered into by the County pursuant to a competitive sealed process in compliance with City laws, policies, and procedures; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The accessing of the Contract for Citywide use pursuant to Section 18-111 of the City Code with various pre -qualified vendors, which was competitively solicited and is effective through February 28, 2024, subject to any renewals, extensions, and/or replacement contracts by the County, is authorized.' Section 3. Funds are allocated from the various sources of funds from the end user departments and agencies, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to execute the City's Supplemental Agreement to the Contract, in a form acceptable to the City Attorney. Section 5. The City Manager is further authorized' to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption.
