Purpose of Item: The nature of this item is to authorize a Resolution of the Miami City Commission, accepting the bid received on January 6, 2020, pursuant to Invitation for Bid ("IFB") No. 1140381, for the provision of scuba diving equipment, accessories, repairs, and maintenance, on an as needed basis, from Austin's Diving Center, Inc. ("Austin's"), the lowest responsive and responsible Bidder, for the City of Miami's Police Department ("Police"), for an initial contract term of three (3) years, with the option to renew for two (2) additional one (1) year periods, allocating funds from the Police's General Account Fund 00001.190101.546000.0000.00000, and other sources of funds, subject to the availability of funds and budgetary approval, at the time of the need. Authorizing the City Manager to negotiate and execute all other documents, including any amendments, renewals, and extensions subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: Police has identified a need for the purchase of scuba diving equipment, accessories, repairs, and maintenance, on an as needed basis, for its Marine Patrol Detail Division. On December 9, 2019, the Department of Procurement ("Procurement") issued IFB No. 1140381. As required by the Procurement Code, the IFB was advertised and issued on- line. On January 6, 2020, at the bid closing, two (2) bids were received. All bids were evaluated and tabulated. Procurement is recommending award to Austin's, which met all requirements, per the bid specifications, and is the lowest responsive and responsible Bidder. On June 15, 2020 Procurement sent a Best and Final Offer letter, whereas Austin's approved a five percent (5%) discount on all line items for the first year of the contract. The estimated contract amount is $31,528.00 annually (approximately $157,640.00 for all five (5) years in the aggregate). The funds will be allocated from the Police's General Account Fund 00001.190101.546000.0000.00000, and other sources of funds, subject to the availability of funds and budgetary approval, at the time of the need. WHEREAS, the City of Miami's ("City") Police Department ("Police") has a need for scuba diving equipment, accessories, repairs, and maintenance for its Marine Patrol Detail Division; and WHEREAS, on December 9, 2019, the Department of Procurement ("Procurement") issued Invitation for Bids ("IFB") No. 1140381 to establish a contract for the provision of scuba diving equipment, accessories, repairs, and maintenance on an as -needed basis; and WHEREAS, bids in response to this IFB were received on January 6, 2020 and Austin's Diving Center, Inc., a Florida profit corporation ("Austin's"), is the lowest responsive and responsible bidder; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bid received January 6, 2020 pursuant to IFB No. 1140381 for the provision of scuba diving equipment, accessories, repairs, and maintenance, on an as -needed basis, from Austin's, the lowest responsive and responsible bidder, for an initial period of three (3) years with an option to renew for two (2) additional one (1) year periods is accepted. Section 3. Funds are allocated from Police General Account Fund No. 00001.190101.546000.0000.00000 and such other sources of funds at the time of need, subject to the availability of funds and budgetary approval. Section4. The City Manager is authorized' to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
