ENVIRONMENTAL HEALTH ASSESSMENT
On October 2, 2018 the Department of Health received a request regarding a possible public
health sanitary nuisance in the area between NW 1 st Avenue and NW 2nd Avenue and NW 12th
Street and NW 14th Street.
NARRATIVE:
On the morning of October 3, 2018, Samir Elmir, Ph.D., P.E., Director of Environmental Health,
Jessica Bermudez, Sanitation and Safety Supervisor, and Archibal Miracle, Environmental
Specialist II conducted a field assessment of the area around NW 14th Street and 1St Avenue,
and NW 14th Street and 2ND Avenue. Officer Tasheba Pratt, Neighborhood Resource Officer and
Officer Dairon Williams, Neighborhood Resource Officer, from the City of Miami Police
Department were also present.
FINDINGS:
Note that since there is no distinct address to identify the areas investigated, the addresses
provided for each location designate the intersection nearest in proximity. The term `Bridge
Area' refers to the physical road, sidewalks, and fenced areas beneath the bridge created by the
1-395 freeway. Areas identified as Locations 1, 2, and 3 are owned by the Florida Department of
Transportation with right of way/easement access by the City of Miami. Location 4 is privately
owned.

Location 1- NW 14th Street & 1St Place, Bridge Area under 1-395
The inspectors and officers walked from NW 14th Street travelling south to the edge of the 1-395
Bridge on NW 1 st Place (see Map 1). A chain-link fence separated the sidewalks on the east
and west side of the street from the grassy area where the highway structures stand. Violations
were observed in this fenced area. A large puddle of stagnant water was observed on the east -
side fenced area, as well as food waste and garbage. A storm drain on the east -side fence
appeared to be obstructed by garbage but no water pooling was observed.
An offensive odor was present around the area. Several individuals were observed using the
sidewalk area as their dwelling. Personal items observed included mattresses, dressers,
couches, and clothing suspended from the fences. Human waste, refuse, and pharmaceutical
waste was observed. Make -shift containers were being used for urination and defecation.
Human feces was observed on the east sidewalk. An open container of food waste was found
infested with ants on the west sidewalk. At the time of investigation, individuals at the location
reported the presence of rats. Rats were not observed at the time of investigation.
Images A -C are located on the east side of the street. Images D -F are located on the west side
of the street.
The following violations of Chapter 386 F.S. were found:
1. Rodent harborage conditions (Image 1A and Image 1F)
2. Conditions capable of breeding flies, mosquitos, or other arthropods (Images 1A, 1C,
and 1 E)
3. Untreated human waste, garbage and dangerous waste materials. (Images 1 B, 1 D, 1 F)
4. Noisome odors

Location 2- NW 14th Street & 2nd Avenue, Bridge Area under 1-395
The inspectors and officers walked from NW 14th Street travelling south to the edge of the 1-395
Bridge on NW 2nd Avenue.
A chain-link fence separates the sidewalks on the east and west side of the street from the
grassy area where the highway structures stand. Violations were observed in the fenced area.

the east -side fence, as well as food waste, garbage, and biomedical waste (used syringes). The
west -side fence area contained trash, syringes and needles on the ground. Personal items on
the sidewalk observed were mattresses, couches, bicycle parts, and clothing suspended on the
fences. The east and west sidewalks contained garbage, human waste, and biomedical waste
(used syringes and needles).
Images A -B are located on the fenced area east of NW 2nd Avenue. The orange objects visible
in Images A & D were identified as syringe caps from syringes . Images D -F are located on the
west side of the street.
The following violations of Chapter 386 F.S. were found:
1. Untreated garbage and dangerous waste materials (Image 2C and Image 2D)
2. Condition that may breed flies, mosquitos or other arthropods (Image 2A and Image 2B)
3. Rodent harborage (Image A and Image B)
4. Noisome Odors
Location 3- NW 14th Street & 2nd Avenue (North side), Bridge Area under 1-395
This area was identified to be a site used for urination and defecation by individuals
congregating in Location 2, specifically the large bushes and foliage. The physical location in
question was sectioned off by chain-link fences, but visible from the NW 14th Street sidewalk. An

offensive odor of urine and feces was present. The sidewalk area contained personal items
including a mattress, clothing, and a cooler. Biomedical waste (used syringes and needles)
were observed near these items.
Images A -C were all taken from the sidewalk facing north on NW 14th Street.
The following violations of Chapter 386 F.S. were found:
1. Noisome odors
2. Condition that may breed flies or other arthropods (Image 3A)
3. Improperly disposed biomedical waste (syringes and needles) (Image 3C)
Location 4- NW 14th Street & 2nd Avenue (North side), Reverand Lincoln Art Gallery
This area is a grassy corridor located behind the art gallery. It was identified as a site used for
urination A strong noisome odor of urination and defecation was present. Human feces and
garbage were observed.
The following violations of Chapter 386 F.S. were found:
1. Noisome odors
2. Condition that may breed flies or other arthropods (Image 4A and Image 4B).
3. Untreated human waste and garbage (Image 4A and Image 4B).
CONCLUSION:
Based on the above observations, the sanitary nuisance complaint is valid (i.e rodent
harborage, conditions that accumulate water and may lead to mosquito/flies breeding,
conditions that may breed flies or other arthropods, improperly built or maintained privy,
untreated or improperly treated human waste). Note that due to the varying locations and nature

of biomedical waste around the sites, hazardous waste pickup should occur by certified
professionals trained in biomedical waste pick-up. Environmental Health division should be
contacted before sanitation of the area.
The public health sanitary nuisance injurious to health as defined under Chapter 386 is valid
and applicable to the site.
