HomeMy WebLinkAboutR-20-02290FCity of Miami G�TY 'LJ 1 Legislation * IA61RR uuu �F l ° R I° Resolution: R-20-0229 File Number: 7639 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/23/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN INTERLOCAL AGREEMENT, ANY AMENDMENTS, MODIFICATIONS, RENEWALS, AND EXTENSIONS THERETO, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, WITH MIAMI-DADE COUNTY ("COUNTY") AND, IF NECESSARY, THE CITY OF CORAL GABLES FOR THE DEVELOPMENT OF THE COMMODORE TRAIL MASTER PLAN AND THE CONSTRUCTION OF THE PORTION OF THE COMMODORE TRAIL WITHIN THE LIMITS OF THE CITY OF MIAMI ("CITY"); FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT, ALLOCATE, AND APPROPRIATE FUNDS FROM THE COUNTY THROUGH COMMISSIONER XAVIER L. SUAREZ'S OFFICE IN A TOTAL AMOUNT NOT TO EXCEED ONE MILLION, SEVEN HUNDRED SEVENTY-EIGHT THOUSAND DOLLARS ($1,778,000.00) FOR THE DEVELOPMENT OF THE COMMODORE TRAIL MASTER PLAN AND THE CONSTRUCTION OF THE PORTION OF THE COMMODORE TRAIL WITHIN THE CITY'S LIMITS. SPONSOR(S): Mayor Francis X. Suarez, Commissioner Ken Russell WHEREAS, the Commodore Trail is an approximately five (5) mile paved bicycle and pedestrian pathway that traverses through the City of Miami ("City") and the City of Coral Gables ("Coral Gables"); and WHEREAS, the trail measures half (%2) a mile in Coral Gables with the remaining portion in the City; and WHEREAS, the Commodore Trail begins at Coco Plum Road in the south where it connects with the Old Cutler Trail and ends at Brickell Avenue in the north as it connects to the Rickenbacker Trail; and WHEREAS, the Commodore Trail is one of the most recognized and used trails in all Miami -Dade County ("County") and it is a vital connection to multiple surrounding trails and planned trail projects; and WHEREAS, on June 18, 2020, the Dade County's Transportation Planning Organization passed Resolution No. 19-2020 supporting designation of the Commodore Trail, Rickenbacker Trail, and Old Cutler Trail corridors as land trail priorities in the Florida Greenways and Trails System to enhance their funding eligibility under State programs, such as the Florida Department of Transportation's shared -use nonmotorized (SUN) trail program; and WHEREAS, County Commissioner Xavier L. Suarez has set aside Two Million, Twenty - Eight Thousand Dollars ($2,028,000) ("Total Funding") to be used to develop a Commodore Trail master plan and design guidelines, to repair current life, health, and safety issues along the Commodore Trail, and to reconstruct priority trail segments; and City of Miami Page 1 of 2 File ID: 7639 (Revision: A) Printed On: 812412020 File ID: 7639 Enactment Number: R-20-0229 WHEREAS, the revitalization project contemplates the City and Coral Gables working collaboratively to design and construct trail repairs in their respective jurisdictions and would require each municipality to enter into a separate interlocal agreement with the County to ensure the work is consistent with the County's right-of-way and trail policies and design standards in exchange for funding; and WHEREAS, the City will lead the master planning efforts to develop a design and guidelines for the full length of the Commodore Trail ("Master Plan"); and WHEREAS, the share of the Total Funding the City will receive is One Million, Seven Hundred Seventy -Eight Thousand Dollars ($1,778,000.00) for the development of the Master Plan and the construction of the portion of the Commodore Trail within the City's limits; and WHEREAS, the County will continue to maintain the Commodore Trail after the City and Coral Gables construct trail repairs in their respective jurisdictions; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized' to negotiate and execute an Interlocal Agreement, any amendments, modifications, renewals, and extensions thereto, all in forms acceptable to the City Attorney, with the County and, if necessary, Coral Gables for the development of the Master Plan and the construction of the portion of the Commodore Trail within the City's limits. Section 3. The City Manager is further authorized' to accept, allocate, and appropriate funds from the County through Commissioner Xavier L. Suarez's Office in a total amount not to exceed One Million, Seven Hundred Seventy -Eight Thousand Dollars ($1,778,000.00) for the development of the Master Plan and the construction of the portion of the Commodore Trail within the City's limits. Section 4. The Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: i ria ndez, City Attor iey 7/13/2020 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
