A RESOLUTION OF THE MIAMI CITY COMMISSION EXTENDING THE TEMPORARY
OUTDOOR DINING PROGRAM ESTABLISHED PURSUANT TO RESOLUTION NO.
R-20-0156 ADOPTED ON MAY 14, 2020 FROM AUGUST 20, 2020 THROUGH
JANUARY 31, 2021 IN ORDER TO CONTINUE TO ASSIST STRUGGLING
BUSINESSES AFFECTED BY THE NOVEL CORONAVIRUS PANDEMIC; DIRECTING
THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO
THE OFFICIALS NAMED HEREIN.
WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida
Statutes, Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12,
2020 that a State of Local Emergency exists within the City in response to the Novel
Coronavirus ("COVID-19") pandemic; and
WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes,
the Mayor has extended the State of Local Emergency; and
WHEREAS, as a result of the State of Local Emergency, many businesses were closed
and residents were directed to stay at home; and
WHEREAS, on May 14, 2020, the City Commission adopted Resolution No. R-20-0156
authorizing the City Manager to identify feasible portions of City rights-of-way that may be
repurposed for pedestrian and sidewalk cafe usage and to take any and all steps necessary to
effectuate such repurposing until August 20, 2020 in order to assist businesses negatively
affected by the COVID-19 pandemic; and
WHEREAS, as the COVID-19 pandemic continues, the City Commission wishes to
extend the program until January 31, 2021 in order to continue to assist struggling businesses;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The program created by Resolution R-20-0156 adopted on May 14, 2020
which provided for an expiration date of said program of August 20, 2020 is hereby extended
until January 31, 2021 with all other provisions of such Resolution to remain the same.
Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to the
Miami -Dade County ("County") Board of County Commissioners, the County Mayor, and the
Director of the County's Department of Transportation and Public Works.
Section 4. The Resolution shall become effective immediately upon its adoption.
