WHEREAS, since April 2018, the Miami -Dade Police Department (MDPD) and the
City of Miami Police Department (MPD) have engaged in a joint effort to reduce the gun -
related violence on the streets of Miami -Dade County by increasing the police presence
and patrol service in the area of Lincoln Fields; and
WHEREAS, this collaborative violence reduction initiative is called Miami -Dade
County Operation Blue and Brown; and
WHEREAS, the MDPD and the MPD desire to continue working together for the
benefit of the community; and
WHEREAS, the Florida Department of Law Enforcement (FDLE) received an
appropriation allocation for the 2019-2020 fiscal year in the Agreement of $500,000 in
pass-through funding for the MDPD to continue Miami -Dade County Operation Blue and

WHEREAS, this Agreement is entered into by Miami -Dade -County (the County),
by and though its department, the Miami -Dade Police Department (MDPD) and the City
of Miami (the City), by and through its department, the Miami Police Department (MPD),
to share funding for the continuation of Miami -Dade County Operation Blue and Brown,
and
NOW, THEREFORE, BE IT KNOWN that the County and the City, inconsideration
for mutual promises and covenants contained herein, agree to fully and faithfully abide
by, and be bound by, the following terms and conditions:
1. PURPOSE
The goal of Miami -Dade County Operation Blue and Brown is to reduce violent
crimes, specifically crimes related to gun violence, by increasing police
presence in the geographical areas which have experienced a recent
significant increase in gun -related crimes and narcotics sales/use,
11. SCOPE
This Agreement delineates the responsibilities and scope of work expected for
participation in Miami -Dade County Operation Blue and Brown, Project 2020.
Funds have been provided to the County by the FDLE. The County shall sub -
award funds to the City in the amount of $165,000 for its participation in
Operation Blue and Brown, Project 2020,
Ill. RESPONSIBILITIES OF THE COUNTY
The County, by and through the MDPD, agrees to:
A. Authorize its Fiscal Administration Bureau to administer this Agreement as
outlined herein,
B. Review submitted reimbursement requests and Deliverable Reports in
accordance with Attachments A -D.
C. Comply with the requirements or statutory objectives of state law as
stipulated in Attachment E.
D. Ensure satisfactory progress toward the goals or objectives stipulated in
Attachment E.
E. Follow grant agreement requirements and/or State Financial Assistance
Standard Conditions as stipulated in Attachment E.
F. Make payment within 30 calendar days after receipt of the City's
reimbursement request, unless there is reason to believe that the request
is improper. If the request is found to be improper, it will be returned to the
City for revision. Upon submission of a revised reimbursement request, a
new 30 day calendar period will begin.
G. Submit required reports to FELE,
The City, by and through the MPD, agrees to:
A. Provide an administrative liaison to coordinate financial and programmatic
compliance.
B. Abide by all grant requirements including but not limited to budget
authorizations, required accounting and reporting expenditures, proper use
of funds, and tracking of assets as stipulated in Attachment E.
C. Submit monthly reports to the MDPD detailing the services provided as
stipulated in Attachment E.
D. Participate as a member of Operation Blue and Brown, to include
coordinating with and assisting the MDPD in conducting all police
operations.
E. Comply with the requirements and operational objectives of Operation Blue
and Brown as stipulated in Attachment E.
F. Ensure satisfactory progress toward the goals or objectives as stipulated
in Attachment E.
G. Submit monthly reimbursement requests by the Stn day of the following
month, for amounts not to exceed $165,000 in total for the 2019-2020
Fiscal Year, using the Financial Claim Reports, Attachments A, B and C.
H. Provide monthly deliverables using Miami -Dade Police Department Sub
Award Agreement to Miami Police Department Monthly Deliverables for
Financial and Programmatic, Attachment D.
A. The funding acquired and identified for the Operation Blue and Brown
Project will be administered solely by the MDPD.
B. The MPD will provide financial and performance reports to the MDPD in a
timely fashion. The MDPD will prepare consolidated reports for submission
to the State of Florida as stipulated in Attachment E.
C. The County is not responsible for personnel salaries, benefits, workers
compensation or time related issues of the MPD personnel.
D. This is a reimbursement grant that requires the MPD to purchase, receive,
and pay invoices in full for equipment, services, and allowable personnel
cost PRIOR to submitting the same for reimbursement to the IVIDPD.
E. Grant award recipients that expend a total amount of state financial
assistance equal to or in excess of $750,000 or more in any fiscal year
must have a State single or project -specific audit for such fiscal year in
accordance with Florida Statutes Section 215.97.
F. All records received or created shall be made available at all reasonable
times for inspection, review, copying, or audit by MDPD, FDLE, or other
persons as required by Florida law,
G. All financial commitments herein are made subject to the availability of
funds and the continued mutual agreements of the parties as identified in
Attachment F.
V1. INDEMNIFICATION
Each party to this Agreement agrees to assume responsibility for the acts,
omissions, or conduct of such party's own employees while participating herein
and pursuant to this Agreement, subject to the provisions of Section 768,28,
Florida Statutes, where applicable, "Assume Responsibility" shall mean incurring
any and all costs associated with any suit, action, or claim for damages arising
from the performance of this Agreement.
Neither party shall assign any of the obligations or benefits of this Agreement,
This Agreement shall become effective on the date of execution by all parties, and
unless terminated or cancelled on an earlier date, will continue through April 30,
2020, the date on which all reporting requirements as detailed herein are due to
the MDPD. This deadline may be extended if authorized via a grant extension
and executed in compliance with Section X below.
IX NOTICES
All notices to include invoices required or permitted under this Agreement shall be
in writing and delivered by personal service, mailing the same by United States
mail, or via electronic mail, addressed as follows:

This Agreement may be amended as may be necessary, including to remain
consistent with Miami -Dade County Operation Blue and Brown requirements,
amendments or extensions, Such amendments shall be made in writing and shall
be effective only when signed by all parties.
I. CANCELLATION
This Agreement may be cancelled by either party upon providing ninety days
written notice to the other party, Cancellation will be at the discretion of the
parties; in the case of Miami-Dade County, the Police Director and County Mayor
or the Mayor's designee are authorized to cancel this Agreement.
IN WITNESS WHEREOF, the parties have caused this Agreement to be
executed by their respective and duly authorized officers on the day and year
written below.
