Subject: Authorize Amendment 1 - Brickell Avenue Landscaping and Maintenance
Services
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission with
attachments, authorizing Amendment No. 1, for an addition to services required; and further,
authorizing an increase to the Professional Services Agreement with Florida Turf and
Landscaping Horticulture, Inc., for the provision of Brickell Avenue landscaping and
maintenance services including additional services for an irrigation project for the purchase,
installation, inspection, testing and operation of a pressure vacuum breaker at a City water
service connection in a not -to -exceed amount of $527,215.00, thereby increasing the annual
compensation limit from $427,215.00 to an amount not -to -exceed $527,215.00 to account for an
additional extension year in the amount of $427,215.00 and $100,000.00 for the additional
services; for Invitation for Bid (IFB) No. 14-15-019, Brickell Avenue Landscaping and
Maintenance, with Florida Turf and Landscaping Horticulture, Inc., authorized by Resolution No.
15-0257, adopted on June 11, 2015; allocating funds from City of Miami Department of
Resilience and Public Works (Public Works), subject to the availability of funds and budgetary
approval at the time of need; authorizing the City Manager to execute Amendment No. 1 in
substantially the attached form; further authorizing the City Manager to negotiate and execute
all other documents, including any amendments, renewals, and extensions subject to
allocations, appropriations and budgetary approval having been previously made, and in
compliance with applicable provisions of the code of the City of Miami, Florida, as amended,
("City Code"), including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and
Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable
to the City Attorney, and in compliance with applicable regulations, as may be necessary for
said purpose.
Background of Item:
The City entered into an agreement with Florida Turf and Landscape Horticulture, Inc. (Florida
Turf) on August 15, 2015, pursuant to Resolution No. 15-0257, Invitation for Bid No. 14-15-019,
for Brickell Avenue landscaping and maintenance services. Public Works currently requires the
installation of a pressure vacuum breaker at the water service connection that supplies lawn
irrigation at multiple locations along Brickell Bay Drive and Brickell Avenue. In accordance to
Section 00800, General Conditions, Subsection 54, Additions/Deletions of Services Required, in
the IFB, the City may add additional services to any resultant contract upon successful
negotiations and mutual consent of the contracting parties. Florida Turf provided an acceptable
proposal for the irrigation project. Additionally, work under this contract was delayed due to the
COVID-19 Emergency. The City will also extend the contract for one (1) year to allow for the
work delayed due to COVID-19 and for the additional services for the irrigation project to be
completed The estimated cost for this one-year extension and irrigation project is $527,215.00.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AMENDMENT
NO. 1 TO THE AGREEMENT BETWEEN THE CITY OF MIAMI ("CITY") AND FLORIDA
TURF AND LANDSCAPE HORTICULTURE, INC., A FLORIDA PROFIT
CORPORATION ("FLORIDA TURF"), PURSUANT TO INVITATION FOR BID ("IFB")
NO. 14-15-019 FOR BRICKELL AVENUE LANDSCAPING AND MAINTENANCE
SERVICES ("SERVICES"), PROVIDING FOR 1) A ONE (1) YEAR EXTENSION OF
TIME BEYOND THE TERMS OF THE AGREEMENT FOR PENDING PERFORMANCE
OF THE SERVICES; 2) THE PURCHASE, INSTALLATION, INSPECTION, TESTING,
AND OPERATION OF A PRESSURE VACUUM BREAKER AT A CITY WATER
SERVICE CONNECTION ("ADDITIONAL SERVICES") REQUIRED FOR AN
IRRIGATION PROJECT; AND 3) AN INCREASE IN AGREEMENT CAPACITY TO A

PUBLIC WORKS ("PUBLIC WORKS") SUBJECT TO THE AVAILABILITY OF FUNDS
AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE AMENDMENT NO. 1 TO THE
AGREEMENT WITH FLORIDA TURF, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS,
RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS,
APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL
APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), INCLUDING THE CITY'S PROCUREMENT ORDINANCE,
ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET
FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES,
AND REGULATIONS AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 15-0257 adopted on June 11, 2015, the City
Commission authorized the City Manager to enter into an Agreement with Florida Turf and
Landscape Horticulture, Inc., a Florida profit corporation ("Florida Turf'), in accordance with
Invitation for Bid ("IFB") No. 14-15-019 for Brickell Avenue Landscaping and Maintenance
Services ("Services") for an initial one (1) year period with four (4) additional one (1) year
renewal periods at an annual not to exceed amount of Four Hundred Twenty Seven Thousand
Two Hundred Fifteen Dollars ($427,215.00), subject to the availability of funds; and
WHEREAS, the City of Miami's ("City") Department of Resilience and Public Works
("Public Works") requires additional services for the installation of a pressure vacuum breaker at
the water service connection that supplies lawn irrigation at multiple locations along Brickell Bay
Drive and Brickell Avenue ("Additional Services") required for an irrigation project at a cost of
One Hundred Thousand Dollars ($100,000.00); and
WHEREAS, in accordance with IFB No. 14-15-019, Section 00800 General Conditions,
Subsection 54 Additions/Deletions of Services Required, the City may add the Additional
Services to the Agreement upon successful negotiations and mutual consent of the City and
Florida Turf; and
WHEREAS, due to the ongoing COVID-19 Emergency, there have been delays in the
performance of the Services under this Agreement; and
WHEREAS, this Agreement is currently in its fourth (4th) and final renewal period which
will expire on August 31, 2020; and
WHEREAS, pursuant to Section 3 of IFB No. 14-15-019, the Agreement can be
extended by one (1) additional year, as deemed in the City's best interest, to allow for
performance of both the Services that have been delayed and the Additional Services currently
required for completion of the irrigation project; and
WHEREAS, it is in the best interest of the City to increase the Agreement's capacity
from the annual not to exceed amount of Four Hundred Twenty Seven Thousand Two Hundred
Fifteen Dollars ($427,215.00) to the not to exceed amount of Five Hundred Twenty Seven
Thousand Two Hundred Fifteen Dollars ($527,215.00) to accommodate the pending
performance of the Agreement's Services and address the Additional Services required for an
irrigation project during the one (1) year extension;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in the Section.
Section 2. Amendment No. 1 to the Agreement between the City and Florida Turf
pursuant to IFB No. 14-15-019 for the Services providing for 1) a one (1) year extension of time
beyond the terms of the Agreement for pending performance of the Services; 2) the Additional
Services required for an irrigation project; and 3) an increase in Agreement capacity to a not to
exceed amount of Five Hundred Twenty Seven Thousand Two Hundred Fifteen Dollars
($527,215.00) comprised of Four Hundred Twenty Seven Thousand Two Hundred Fifteen
Dollars ($427,215.00), the Agreement amount for one (1) year of Services, and One Hundred
Thousand Dollars ($100,000.00), the amount for the Additional Services required for the
irrigation project, is hereby authorized.'
Section 3. Funds shall be allocated from Public Works subject to the availability of funds
and budgetary approval at the time of need.
Section 4. The City Manager is authorized' to negotiate and execute Amendment No. 1
to the Agreement with Florida Turf, in a form acceptable to the City Attorney.
Section 5. The City Manager is further authorized' to negotiate and execute any and all
other documents, including any amendments, renewals, and extensions, subject to all

allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions
of the Code of the City of Miami, Florida, as amended (City Code), including the City's
Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with
all applicable laws, rules, and regulations as may be deemed necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption.
