RE: Resolution No. 20-0129 — Programmatic Agreement

At its April 23, 2020 meeting, the City Commission adopted the above -referenced agenda item,
RE.1, authorizing the City Manager to enter into a Programmatic Agreement for an additional five (5)
years with the Florida State Historic Preservation Office, the Advisory Council on Historic Preservation,
and any other agency, as required, to expedite the City of Miami's fulfillment of its historic preservation
responsibilities as a recipient and administrator of federal funds under Section 106 of the National
Historic Preservation Act. The item inadvertently contained an incorrect description of the effective date
of the Resolution in Section 3.
The Legislation has been corrected and incremented to Revision A.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO A
PROGRAMMATIC AGREEMENT FOR AN ADDITIONAL FIVE (5) YEARS, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA STATE
HISTORIC PRESERVATION OFFICE, THE ADVISORY COUNCIL ON
HISTORIC PRESERVATION, AND ANY OTHER AGENCY, AS REQUIRED, TO
EXPEDITE THE CITY OF MIAMI'S FULFILLMENT OF ITS HISTORIC
PRESERVATION RESPONSIBILITIES, ASA RECIPIENT AND
ADMINISTRATOR OF FEDERAL FUNDS UNDER SECTION 106 OF THE
NATIONAL HISTORIC PRESERVATION ACT.
WHEREAS, the Miami Historic and Environmental Preservation Board ("HEPB"), at its
meeting on May 1, 2012, following an advertised public hearing, adopted Resolution No. HEPB-
2012-30, attached and incorporated as Exhibit "B," by a vote of seven to zero (7-0), Item No. 13,
recommending approval of the Programmatic Agreement; and
WHEREAS, the City Commission, at its meeting on May 24, 2012, following an
advertised public hearing, adopted Resolution No. 12-0217 by a vote of four to zero (4-0), Item
No. PZ.2, approving the Programmatic Agreement, attached and incorporated as Exhibit "C";
and
WHEREAS, the HEPB, at its meeting on March 5, 2019, following an advertised public
hearing, adopted Resolution No. HEPB-R-19-013, attached and incorporated as Exhibit "D," by
a vote of nine to zero (9-0), Item No. HEPB 8, recommending approval of the Programmatic
Agreement, attached and incorporated as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized and directed to enter into a Prograromatip
Agreement, in substantially the attached form, with the Florida State Historic Preservation
Office, the Advisory Council on Historic Preservation, and any other agency, as required, tp w

expedite the City of Miami's fulfillment of its historic preservation responsibilities as a,recipleflt
and administrator of Federal funds, under Section 106 of the National Historic Preservation, -A- ct.'
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.Z,
If the Mayor does not sign this Resolution, it shall become effective at the erid o* en
(10) calendar days from the date it was passed and adopted. If the Mayor vetoes this
