HomeMy WebLinkAboutR-20-0165City of Miami q Legislation Resolution: R-20-0165 File Number: 7455 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 6/11/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CLASSIFYING, PURSUANT TO SECTION 18-82(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, A 1949 PLYMOUTH MOTOR VEHICLE AS DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, AS CATEGORY "A" SURPLUS STOCK; DONATING SAID VEHICLE IN AN "AS IS" CONDITION AND WITHOUT WARRANTY TO THE MIAMI POLICE BENEVOLENT ASSOCIATION, INC. UPON THE EXECUTION OF THE APPROPRIATE RELEASE DOCUMENTS. SPONSOR(S): Commissioner Ken Russell, Commissioner Joe Carollo, Commissioner Manolo Reyes WHEREAS, the City of Miami ("City") owns a 1949 Plymouth motor vehicle ("Surplus Vehicle") that has been painted and equipped to resemble a City Police car from the 1950s; and WHEREAS, the Surplus Vehicle was originally owned by the Miami Fraternal Order of Police and used as a ceremonial vehicle in parades and similar events and was later sold to the City to be used in a similar fashion and for community relations reasons; and WHEREAS, the Surplus Vehicle has not been driven in many years and its use has been limited to being on static display; and WHEREAS, due to the Surplus Vehicle's minimal use and static display, the City has not been required to procure a tag or motor vehicle registration; and WHEREAS, the City has been unable to locate a Florida Motor Vehicle Certificate of Title or vehicle registration for the Surplus Vehicle and the Surplus Vehicle will have to be donated in its "as is" condition without a warranty; and WHEREAS, the City's Chief Procurement Officer has declared the Surplus Vehicle as Category "A" stock; and WHEREAS, pursuant to Section 18-82(a) of the Code of the City of Miami, Florida, as amended ("City Code"), Category "A" stock is available for disposition as the City's contribution or the City's commitment in support of a particular public purpose, which may include community, civic, or social service programs as may be authorized by the City Commission; and WHEREAS, the Miami Police Benevolent Association, Inc. ("PBA") is a Florida Not for Profit corporation comprised primarily of veterans of the Miami Police Department and their families and they perform community, civic, and social programs and are qualified to receive surplus stock; and WHEREAS, the Miami City Commission finds it in the best interests of the City to donate the Surplus Vehicle to the PBA for the Surplus Vehicle's continued useful service to the City of Miami Page 1 of 2 File ID: 7455 (Revision:) Printed On: 6/12/2020 File ID: 7455 community; Enactment Number: R-20-0165 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 18-82(a) of the City Code, the Surplus Vehicle described in Exhibit "A," attached and incorporated, is classified as Category "A" stock. Section 3. The Surplus Vehicle is hereby donated to the PBA "as is" and without warranty upon the execution of the appropriate release documents. Section 4. The PBA shall solely be responsible for obtaining a title and motor vehicle registration, as necessary. Section 5.
