HomeMy WebLinkAboutR-20-0142City of Miami q Legislation Resolution: R-20-0142 File Number: 7439 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/7/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO MEET WITH THE MAYOR OF MIAMI-DADE COUNTY AND THE DIRECTOR OF THE MIAMI INTERNATIONAL AIRPORT ("MIA") REGARDING THE NEED FOR SCREENINGS AT MIA AND COMPLIANCE WITH GOVERNOR RON DESANTIS' EXECUTIVE ORDER NUMBER 20-80 RELATED TO EMERGENCY MANAGE MENT-COVID-19-AIRPORT SCREENING AND ISOLATION, SPECIFICALLY WITH RESPECT TO THE SCREENING OF PASSENGERS ARRIVING AT MIA; FURTHER AUTHORIZING THE CITY MANAGER TO REQUEST A DELEGATION OF AUTHORITY TO THE CITY OF MIAMI ("CITY") IN COORDINATION WITH THE MIAMI-DADE COUNTY AVIATION DEPARTMENT ("MDAD") TO TAKE ANY AND ALL STEPS NECESSARY TO ENSURE THE SCREENING, APPROPRIATE ISOLATION, AND QUARANTINE OF INDIVIDUALS COVERED BY EXECUTIVE ORDER NUMBER 20-80; DIRECTING THE CITY MANAGER TO REPORT BACK TO THE CITY COMMISSION BY MAY 21, 2020 REGARDING ALL ACTIONS HE HAS TAKEN; FURTHER DIRECTING AND AUTHORIZING THE CITY ATTORNEY TO TAKE ANY AND ALL ACTIONS NECESSARY TO ACCOMPLISH FULL COMPLIANCE WITH SAID EXECUTIVE ORDER; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. SPONSOR(S): Commissioner Joe Carollo WHEREAS, on March 23, 2020, Florida Governor Ron DeSantis entered Executive Order 20-80 relating to Emergency Management-COVID-19-Airport Screening and Isolation ("Executive Order"); and WHEREAS, the Executive Order finds that many cases of COVID-19 in Florida have been as a result of individuals traveling into Florida from international destinations and other states and exposing Florida residents; and WHEREAS, Florida has seen an increase in individuals fleeing to Florida from states where "shelter -in-place" orders are being implemented, including from the New York Tri-State Area; and WHEREAS, the Executive Order directs that the Florida Department of Health ("DOH") take any steps necessary to ensure the screening, appropriate isolation, and quarantine of individuals covered by the Executive Order; and WHEREAS, the Executive Order directs that the DOH coordinate with the Florida Division of Emergency Management, each aviation and airport authority in Florida, county and local governments, and law enforcement agencies to effectuate the isolation or quarantine required by the Executive Order; and City of Miami Page 1 of 2 File ID: 7439 (Revision:) Printed On: 5/14/2020 File ID: 7439 Enactment Number: R-20-0142 WHEREAS, the necessary screening, appropriate isolation, and quarantine of individuals covered by the Executive Order are not being undertaken at the Miami International Airport ("MIA"); and WHEREAS, the failure of Miami -Dade County Aviation Department ("Department") to ensure such screening presents a danger to the public health and safety of the residents of the City of Miami ("City"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby directed to meet with the Mayor of Miami -Dade County and the Director of MIA (collectively, "County") regarding full compliance with the Executive Order related to Emergency Management-COVID-19-Airport Screening and Isolation, specifically with respect to screening passengers arriving at MIA. Section 3. The City Manager is authorized to request a delegation of authority to the City in coordination with the Department to take any and all steps necessary to ensure the screening, appropriate isolation, and quarantine of individuals covered by the Executive Order. Section 4. The City Manager is directed to report back to the City Commission by May 21, 2020 regarding his meeting with the County including any and all actions taken by the City Manager. The City Commission will then analyze the findings to determine if legal action is necessary. Section 5. The City Attorney is hereby authorized' and directed to take any and all actions necessary to accomplish full compliance with said Executive Order. Section 6. The City Clerk is directed to transmit a certified copy of this Resolution to Florida Governor Ron DeSantis, Miami -Dade County Mayor Carlos Gimenez, Lester Sola, Director and Chief Executive Officer of the Miami -Dade Aviation Department, the Board of Commissioners of the County, and all municipal mayors in Miami -Dade County. Section 7. This Resolution shall become effective immediately upon its adoption.
