HomeMy WebLinkAboutR-20-0108City of Miami q Legislation Resolution: R-20-0108 File Number: 7307 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 4/9/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL AMOUNT OF $400,000.00 IN THE FORM OF A REIMBURSEMENT GRANT FOR THE PERIOD COMMENCING MAY 1, 2020 THROUGH APRIL 30, 2022 FROM THE NATURE CONSERVANCY ("TNC") FOR THE MORNINGSIDE PARK STORMWATER AND SHORELINE PROTECTION PROJECT, OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-Bl73511A ("PROJECT"); APPROPRIATING THE GRANT FUNDING IN THE AMOUNT OF $400,000.00 FOR SAID PROJECT, SUBJECT TO BUDGETARY APPROVAL AT TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE A GRANT AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH TNC FOR SAID PURPOSE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS TO THE GRANT AGREEMENT, INCLUDING OPTIONS TO RENEW FOR UP TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME NOT -TO -EXCEED AMOUNTS UNDER THE SAME TERMS AND CONDITIONS FOR THE PROGRAM, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT AWARD. SPONSOR(S): Commissioner Ken Russell WHEREAS the City of Miami's ("City") Office of Capital Improvements ("OCI") has been awarded a reimbursement grant from The Nature Conservancy ("TNC") for the execution of design and permitting of a Morningside Park Stormwater and Shoreline Protection Project, OCI Project No. 40-Bl73511A ("Project") in an amount not to exceed $400,000.00; and WHEREAS, the Project emphasizes nature -based solutions for stormwater, seasonal high tides, storm surge, and sea level rise and develops an approach for expanding nature - based solutions for coastal resilience throughout the City; and WHEREAS, natural shoreline features such as healthy coral reefs, mangroves, and beaches reduce wave energy and have the potential to buffer coastal communities from storm surges and sea level rise; and WHEREAS, the City Commission wishes to accept these funds and authorize the City Manager to execute a grant agreement for such a purpose; and WHEREAS, the City Manager and OCI are requesting the appropriation of said grant funding for Fiscal Years 2020-2021 and 2021-2022; City of Miami Page 1 of 2 File ID: 7307 (Revision:) Printed On: 4/28/2020 File ID: 7307 Enactment Number: R-20-0108 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept a total amount of $400,000.00 in the form of a reimbursement grant for the period commencing May 1, 2020 through April 30, 2022 from TNC for the Project and to appropriate said funds for the Project, subject to budgetary approval at time of need. Section 3. The City Manager is further authorized to negotiate and execute a grant agreement, in a form acceptable to the City Attorney, with TNC for said purpose. Section 4. The City Manager is further authorized to negotiate and execute any and all other necessary amendments, extensions, and modifications to the grant agreement, including options to renew for up two (2) additional similar periods at the same not -to -exceed amounts under the same terms and conditions for the program, subject to budgetary approval at time of need, all in forms acceptable to the City Attorney, to implement the acceptance of and compliance with the grant award. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i . ndez, City Attor iey 3/30/2020 ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
