A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO NOT EXPEND ANY ART IN PUBLIC PLACES FUNDS ALLOCATED
AND PLANNED FOR SOUTH SHENANDOAH AND SWANNANOA POCKET PARKS
("SS & S POCKET PARKS") UNTIL THERE HAS BEEN A DECISION BY THE
RESIDENTS WHO PATRONIZE THE SS & S POCKET PARKS; FURTHER
DIRECTING THAT THE ART IN PUBLIC PLACES FUNDS OF TWENTY FOUR
THOUSAND FIVE HUNDRED DOLLARS ($24,500.00) AS PREVIOUSLY ALLOCATED
FOR THE SS & S POCKET PARKS BE MAINTAINED AND HELD UNTIL FURTHER

THOUSAND FIVE HUNDRED DOLLARS ($24,500.00) AS PREVIOUSLY ALLOCATED
FOR THE SS & S POCKET PARKS BE MAINTAINED AND HELD UNTIL FURTHER
NOTICE.
WHEREAS, the City of Miami's ("City") Art in Public Places Program ("Public Art
Program") enhances the aesthetics of the City's parks; and
WHEREAS, on April 5, 2019, the Planning Department, in its role as designee for the
City Manager, proposed to the Art in Public Places Board ("AIPPB") an expenditure of
$13,500.00 from the Art in Public Places Fund for the design, commissioning, acquisition,
installation, and associated costs of public art installation(s) ("Pubic Art") for South Shenandoah
& Swannanoa Pocket Parks ("SS & S Pocket Parks") pursuant to Chapter 62, Article XVI,
Section 62-655 of the Code of the City of Miami, Florida, as amended ("City Code"); and
WHEREAS, on April 15, 2019, the AIPPB approved with conditions the expenditure of
$13,500.00 from the Art in Public Places Fund for Public Art in the SS & S Pocket Parks as
proposed by the Planning Department pursuant to Chapter 62, Article XVI, Section 62-655 of
the City Code, via Resolution No. AIPP-R-19-005; and
WHEREAS, also on April 15, 2019, the AIPPB selected the top three (3) artists from a
Call to Artists to develop proposals and compete for the commission in which each artist
received a $500.00 honorarium for a total expenditure of $1,500.00 by the City; and
WHEREAS, on October 7, 2019, the Planning Department proposed to the AIPPB an
additional expenditure of $13,500.00 from the Art in Public Places Fund to incorporate Public Art
at the SS & S Pocket Parks; and
WHEREAS, no Public Art for SS & S Pocket Parks has been commissioned to date; and
WHEREAS, there was a public meeting held at Shenandoah Park on December 16,
2019 concerning the proposed Public Art installations to be located at the SS & S Pocket Parks;
and
WHEREAS, the majority of the residents who attended the public meeting stated there
had not been any prior meetings or input requested from the residents who use the SS & S
Pocket Parks relative to the Public Art; and

WHEREAS, the majority of the residents who attended the public meeting stated there
had not been any prior meetings or input requested from the residents who use the SS & S
Pocket Parks relative to the Public Art; and
WHEREAS, the residents requested that there be no expenditures made for Public Art
for the SS & S Pocket Parks until their voices can be heard and, in consultation with the District
4 Commissioner, a decision is made as to what, if any, Public Art is to be commissioned and
installed at the SS & S Pocket Parks; and
WHEREAS, the funds for Public Art in the SS & S Pocket Parks ("Art in Public Places
Funds") are to be maintained and held until a decision on the use of these funds is made as
provided in this Resolution; and
WHEREAS, if, at the end of the foregoing period, a final decision is made not to add any
Public Art at the SS & S Pocket Parks, the City Manager will re -allocate the applicable Art in
Public Places Funds currently allocated for the SS & S Pocket Parks totaling twenty four
thousand five hundred dollars ($24,500.00) to be used at Shenandoah Park pursuant to Chapter
62, Article XVI of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and finding contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is directed to not expend any Art in Public Places Funds
for Public Art at the SS & S Pocket Parks until formally advised by Commission District 4 and
after meaningful input from the community regarding the Public Art.
Section 3. The City Manager is additionally directed to hold and maintain intact any Art
in Public Places Funds for the SS & S Pocket Parks until formally advised by Commission
District 4.
Section 4. The City Manager is directed to advise any and all designees, including the
Planning Director and the Public Art Manager, of this Resolution.
Section 5. This Resolution shall become effective immediately upon its adoption.
